Property Custodian
The office of Alien Property
Custodian was created by an act
of Congress known as the “trading
with the enemy act." approved Oc-
tober 6. 1917. Under its terms and
executive orders. it became the duty
of all persons in the United States
having the custody or control of any
property belonging to or held (or
or owing to any enemy person. to
report to the Allen Property Cus-
todian as a common trustee. “Pro-
petty" meant any property in the
United States held for persons or
corporations doingbusiness in Ger-
many. Austria-Hungary. Bulgaria
and Turkey. and in those portions
of Belgium. France. Rum and the
Balkans coupled by the enemy.
The legislative intent was that all
enemy prope‘y. concealed as well
as disclosed. should be placed entire-
ly beyond the control or influence
of its former owners. whence it
could not eventually yield air or
comfort to the enemy.
The law made ample provision for
the full protection of American clti~
zens whoee Just claims or property
rights might be affected by the ad-
ministration of the Alien Property
Custodian.
The Custodian is required-to de-
posit all moneys coming-into his
hands in the Treasury of the United
States. to be invested by the Secre-
tary of the Treasury in United States
bonds or certificates of indebtedness.
All other property is held by the
Custodian as a. trusteeship, subject
to its disposition by Congress.
Allen Property Custodian Palmer
proceeded to liquidate and sell ene-
my-owned buslness in his hands.
Among these transactions was the
sale of certain German dye patents
and copyrights and formulas. to the
so-called Chemical Foundation Co.
about which there has been so much
controversy. Mr. Palmer states that
all sales were passed upon by an
advisory board of business men.
There were five ways in which
alien property was received by the
Custodian:

proximately $552,000,000 in ptupcrty
scattered from the Philippines and
Hawaii to the Atlantic seaboard. in
almost every state. consmting of in-
dustrial plants. wireless plants.
steamships. patents and copy-lights.
banks. land and cattle companies.
salmon factories. gold. silver and
other mines or precious metals. thou.

The last Congress passed an act
prrmitting the custodian to return
all enemy property in trust of the
value of $10,000 and uhder: Ind in
those trusts that, exceed this sum
to return an amount not exceeding
$10,000.
The separate treaty of peace be-
tween the I'nited States and Ger
many (August 35, 1920) provided
that all property of German and
Austria—Hungary nationals selsed in
this country. should be retained un-
til those governments had made pro
vision for the satisfaction of all
American claims.
January 1. 1923. the alien proper-
ty held in this country was about
3341000000.
On the other hand. Americans
have filed with the State' department
claims against: Germany and Austri-
Hungary amounting to something
like a billion dollars. many of which
obviously have no merit.
These claims are varied. some aris—
ing out of the Lusitania disaster.
others arising out of German and
Austrian seizure of American prop-
erty. and still others arising out of
imprisonment. entering. etc.
An agreement has been signed by
the United States and Germany for
a mixed claims commission to settle
these claims. This work is now pro-
greasing.
It is said that ample alien propel-
