Sec. 12. ' Noperson, who has voluntarily
enlistedyor shall hereafter 'volunturil enlist

service for this state under any Call of the
pres dent of the Unlted States, and no. per-
son whohas beam-or shall be drafted, and
shall have performed 'such‘military service,

‘ Sec. 13. No person who shall be drafted
and excusedvou account of disability, shall
be‘ngaiu enrolled, until the next annual en-
rollment in the town in which be me reside”:
and If, for any cause, there shall e a defi-
ciency in the number. of persons required to
be drafted from‘any town, the selectmen of
such t0wn‘_shail continue to draft '- froln'llle

apportioned to such town shall have been

Sec. 14. The commanderlinchief may
appoint the necessary number of post sur-
geons and assistant‘post surgeons, to exam-
me ‘the persons who shall be drafted, and to
decrde upon their abililyto perform military
servrce’, who ma grant certificates of ex-
emplron, particu ary specif therein the
cause 'ofexemption‘, and shill be paid out of
the treasury of the slate such reusbnabie
sum for their services, as may be fixed by
the comm'ander-id-chicf unless they shall
be paid therefor by the United States ;' and .
if anyone ofsuch surgeons shall receive any
otherfee or reward for'such' services, or any
gratuity therefor, or shall knowingly. grant
any certificate of exemption on account of a
'diSability which does notextsi, he shall pay.

fense, or be imprisoned in’a cemmoujail
for a‘ term of six months, or suffer such fine

Sec. 15. When the enrolled militia shall?

said offices shall become vacant, during the
recess of~the general assembly, such vacancy
shall be filled by the .commander—in-chief‘,
and the person so appointed shall hold his
office, until the scssron of the general assem-
bly next after suchjun appointment and un-
til another be chosen in his place. The quar-
termaster-gencrol muy'eppoint, with the ap-

probation of the commander-in-chief, an as-
srstant quartermaster-general,‘ with the rank

of major, for whose conduct he shall be re-

sponsible, and whom he may remove of

pleasure; and the assistant quartermaster—

be appointed from members of the company
to which, they belong; and the musicians
shall be appointed by the commandant of

Sec. 37. Any company may cuactby-laws
for better government and discipline, which,
when approved by the brigadicr-uenerai,
shall be binding upon the members 'Of such

deposited in the arsenal at Hartford, and dis-
tribute them to the militia, in such manner

inventory of all the articles belonging to his
department, specifying the place or- places
where ihey, are deposited, and also, of all
the articles consumed or expended since the
last previ'ons report, together with a particu-
lar account of all expenditures of money,
incurred in his department, of which no‘ac-
count shall have been previously rendered»
to the general assembly : and he shall give
bond thb surety to the state treasurer, in
the eum'of twenty thousand dollars, condi-
tioned for the faithful discharge of the duties

from time to time order all ordnance, mus-

furnished to the militia, which ma be neg-

shall examine, audit, and adjust the items of
his annual report; and in the mouth of April,
annually, shall examine and inspect the ar-
senal buildings at Hartford,and the military
stores and other property of the state there-

dltron thereof, and also of the correctness of
the quartermastcr- enerals report, to the gen-
eral assembly in ay, annually, within the
first three days of the session thereof. ,
Sec. 54. The commissar :general, in time

the attendance of the persons so drafted. at
the time and place of rendezvous, which
shall be appointed in the order of the com-
mander-in-chief. and, if it shall be necessary,
me take charge of such drafted persons,
ad! may command the, assistance of the
constables of the ,town,or ofany other person.
for that purpose ; and any persou,who shall,
when commanded by the selectmen, or by
either of them, refuse to render-such assist-
ance, shall be punished by a fine of seven
dollars, or by imprisonment in a common
jail, not less than ten days, nor more than

drafted from any town. shall fall to be pres-

of the United States. The two sections of
artillery shall be attached to such regiments
as the commander-in-chhaf may designate;
and he may, if he deem it expedient, organ-
ize new companies from time to time, and
attach them to an regiment which has not

company shall be numbered at its formation

Sec. 23. The quartermasier-gcncra], sur--
goon-general, commissary-general, and pay-
musier-gcueral, shall be appointed by the
senate upon the nomination ofthe command-
er-in—cbief, and upon his reco nmcudation

ively, by'ihe senate, and may also be remov-
ed by the commauder-in-chief, during recess
of the general assembly,‘if, in his judgment
the interests of the service Would be promo-
ted thereby. The quartermaeter-general,‘and

sioned officers below the rank of brigadier-
general. Said board shall make a detailed
report to the commander-in-chief within
twenty days after each‘ session; and it shall
be the duty of the commander-in-cbief to re-
voke the appointment of all officers failing
to appear at such examinations, and of all
officers whose examinations thereut may not
be satisfactory ; but any officer who shall

agree with said board upon the compensa-
tion which they shall receive for the servi-
cesprovided in the preceding section, and
upon his certificate the comptroller shall
draw orders upon the treasurer thefnr.

Sec. 33. The resignation of the brigadier-
general, field officers and commissioned offi-
cers of companies shall be made to the com-
mander-iu-chief. The rcsimaiieu of staff
officers shall be made to fire officer from
whom they receive their appointment, and
such resignation, if approved, shall be for-
warded to the commander-iu-chief, who shall
accept such resignation and grant a dis-
charge; Provided, that no resignation shall
take effect until the officer shall turn over to
his successor, or some other proper officer
authorized to receive the same, all property
belonging to the‘siate in his possession, and
shall transmit to the quartermester-general
duplicate receipts showing the delivery of
such property ; and, furthermore, that all
the commissioned officers of any company
shall not be_discharged. until one or more
