Sec. 1. That a term of the Superior Court
shall be held at. Bridgeport. within and for.
Said countv of Fairlie d, on the second
Tuesday of December, in each and every
car, instead of the third Tuesday of Decem-
er, as now by law provided.
Sec. 2. That a term of the Supreme Court
of Errors shall be holden at Bridgeport,
within and for the county of Fairfield, on the
- last Tuesday Of January in each and every
car, instead Of on the first Tuesday of
ebruary, as now bylaw provided.

CHAPTER CXIII.
An act in addition to an Act concerning
Crimes and Punishments.
Be it enacted by the Senate and House of Repre-
sentatives in General.Assembly convened:
Sec. 1. All persons who travel from place
to place withOut any actual evocation ; sleep-
ing in barns or» other outbuildings, or camp-'
ing on the public highway without the con-
sent of the Selectmen of the town; or on
private property without the consent of the
owner, shall be deemed common vagrants,
and shall be punished by a fine not exceed-
ing seven dollars, or by imprisonment in the
common jail not exceeding thirty days, or
by such fine and imprisonment both.
Sec. 2. It shalt be the duty of all inform-
ing officers to make presentment of all cases
arising under this act.

pleas for New Haven county.
Sec. 2. All acts and parts of acts incon-

Every association organized for the pur‘
pose of enlarging any old public burying
ground not owned in fee by any person or
persons, shall enclose and keep the same en-
closed whcn enlarged, and shall have pos-
session and control thereof, and may, with-
out injuring ghe rights of any pgson, lay
and stake out late, establish walks‘ and car-
riage ways , set out flowers, shrubs and trees
therein, and improve and ornament the
same.

An act in addition to “An act for the assess-
ment and collection of taxes.”
B it enacted by the Senate and House Of Repre-
sen tives in General Assembly convened:
That all bonds which may be issued by
any town or city in aid of the construction
of the railroad of “the Connecticut Central‘H
Railroad Company,” in pursuance of legal
votes of such town or city as authorizedby
the. legislature of this state, and all bonds
which may be issued by any town or city to
provide or raise money to pay for stock
subscribed by such town or city, in aid of
said railroad corporation, in pursuance of
legal votes of such town or city, authorized
as aforesaid, shall be exempt from taxation
in the hands of the holders of such bonds,
provrded that whenever the avails of such
bonds or stock shall have been expended in
the construction _of the railroad of said cor-
poration, said railroad corporation shall pay
a tax of one per cent. to the treasurer of this
state, upon the amount of such-bonds issued
by any town or city in aid Of the construc-
tion of such railroad as aforesaid, whether
such- _bonds are owned by pepsons or cor-
porations in this state or elsewhere, and
upon the gmount of stock subscribed by any
town or city in aid of said railroad corpora-
tiOn as aforesaid.

CHAPTER CXX. .
An act to Regulate Jurisdiction in the action
‘ of Replevin.
Be it enacted by the Senate and House of Repre-
sentatives, in General Assembly convened:
Sec. 1. Jurisdiction in actions of replevin
shall be determined in the first instance by
the sum demanded as damages by the plain-
tifl‘ in the writ, for the taking or detention
of the property.
See. 2. in the following classes of such ac-
tions, viz: I
First. Where cattle impounded are re-
plevied by the owner, and the defendant
shall plead, by avowry, that the cattle wci‘e
taken “damage feasant,” and claim therein
as damage done by the cattle, a greater sum_
than that which determines the jurisdi tion
of the court to which the suit is broug .-
Second. Wh- re personal property attach-
ed shall be replevied, by one not a party to
the suit, claiming title or right of possession
thereto, and the attaching creditor shall, by
avowry or special plea, deny such title 9r
right of possession, and put the same in is-
sue, and shall allege the debt or damage for
which it was attached, and the value of the
propert attached to be greater in amount,
each 0 them, than the sum which deter-
mines the jurisdiction of the court to which
the action is brought; and
Third. Where the owners of goods or
property tortiously taken, otherwise than b
attachment, or wrongfully detained, sha l
replevy the same, and the defendant in re.
plevin shall, by avowing or special plea, put
an issue in the title or right of possession of
the plaintiff, and shall alle e the value of the
goods or property replevted to be greater
than that of which the court to which the
action is brought has jurisdiction, the de-
fendant may have right of removal to a
court having jurisdiction of the amount of
damage, debt, or value Of property, as the
case may be, alleged in the avowry or plea,
subject to the limitations and provisions con-
tained in the next section.
Sec. 3. In the aforesaid cases, if the de-
fendant, at the time of pleading or making
avowry before a justice of the peace, or at
the time of pleading or making avowry and
within the first ten court days of the first
term (if the court in which the action is
pending, shall file a motion in writing, ask-
ing such removal, and the 'ustice or court
shall be satisfied, and shall lid on the rec-
ord that the damage demanded as having
been done by the cattle or the debt or dam-
age claimed in the attachment and the'value
of property attached, or the value of the
property tortiously taken or detained ex-
ceed their jurisdiction as aforesaid,such jus-
tice or court shall order such removal, and
shall cause to be transmitted to the proper
court a certified copy of the files, proceed-
ings and records in the case, at the expense
of the defendant; and the case shall there-
upon be entered in the docket of such proper
court, and be further proceede I with there-
in according to law. The legality of any
bond taken in the case shall not be affected
by such removal, but shall continue opera-
tive for the purpose intended; provided, no
removal shall be allowed in any case where
the defendant pleads the general issue, or
gives notice merely of his defence.
Sec. 4. All acts and. parts of acts incon-
sistent herewith are hereby repealed; and
this act shall take effect on the first day of
August next.

Be it enacted by the Senate and House of Repre-
sentaJves in General Assembly convened:
Every person who shall keep a house,
shop, saloon, room, or other place resorted
to for the purpose of gaming, or which is
reputed to be a gaming house, or place fre-
quented for the purpose of gaming, or who
shall engage in the game of faro, or of play-
ing at cards, dice, tables, keno, or any other
game, for money or other valuable thing, or
who shall reside in, or frequent such house,
shop, saloon, room. or place, for the purposes
aforesaid, shall be punished by a fine not
exceeding one hundred dollars, or by im-
prisonment in a common jail not exceeding
six months, or by such fine and imprison-
ment both.

An act concerning Reformatory Institu-

Be it enacted by the Senate and House of Repre-
sentatives in General Assembly convened :
Sec. 1. That the resident cler y of every
dcnom tion in the several loca ities where
State ormatory institutions are placed,
shall‘be permitted at all proper titnes to visit
such institutions for the purpose Of impart-
ing religions instruction to the inmates
thereof, and performing all necessary rites
pertainin to their respective creeds. ,
Sec. 2. he authority hereby conferred to
be exercised under such necessary rules as’
shall be prescribed by the superintendents
of said institutions."
Sec. 2. This act shall take effect from its
passage.

An act to Confirm Deeds in Certain Cases.
Be it enacted bv the Senate and House of Repre-
sentatives in General Assembly convened:
That whenever any deed or other instru-
ment which is required by law to be acknowl-
edged by the party executing the same be-
fore an ofiiccr authorized to take the ac-
knowled ment thereof, has been acknowl- '
edged be ore a person whOse Ofiicial term
has expired, and within 'six months after the
expiration thereof, such deed or other instru-
ment is hereby. validated and confirmed, and
made as effectual to all intents and purposes
as if the same had been acknowledged before
an officer'lt gally authorized to take such ac-

savings banks in this State, whose treasur-
ers are also cashiers of any national bank,

tations to he made at least once in each car,
at a time to be a eed on by said Bank om-
missioners and xaminers.

ciety in this State shall neglect to attend the
annual or special meetings of the corpora-
tors of said savings bank or savings society
for three successive years, without reason-
able excusc, or shall be convicted of any
crime, his place as such corporator may be
declared and become vacant by a unanimous
vote of said corporators at any annual meet-
ing thereof. ' .
Sec. 2. This act shall take effect from and
after the da _ Ofits passage.

lion, and who enlisted fiom and were credit-
ed ou the quota of this State, and who are
receiving a pension-from the United States
Government on account of wounds .Or dis-
abilities received or disease contracted; in
said service, and the widows and mothers of
such soldiers or sailors who are receiving a
pension from the United States Government
on account ofanysnch soldier or sailor who
died or was killed in said service, shall; to
the amount of one thousand dollars, be ex-
em t from taxation.
