The opening gun of what looks like a
war to the knife between the Select-
men and School Visitors of Norwalk
over the question. of evening schools
was fired \‘v’ednesday, when Jeremiah
Donovan, one of Norwnlk’s heaviest
taxpayers, through Davenport '&
O’Hara. of Bridgeport, secured from
Judge Ralph Wheeler an injunction re-
straining the seleclmen. town treaSurer
and town from paying .1 av monies from
the town treasury towards the support
of evening schools established by them,
and restraining the selectmcn from es-
tz‘ibiishin;r and maintaining evening
schools. , '

By authority of the State of Connec-
ticut youare hereby commanded to
summon the Town of Norwalk, :1 muni-
cipal corporation existing under the
laws of [the state of Connecticut,
and _ Oscar W. Raymond, Tull-
madge Baker and Samuel Dnskam,
and \Villiam A. Curtis, all of
said Town of Norwalk, to appear be-
fore the Superior Court to be held
in and for Fairfield County on the first
Tuesday of January, 1804, then ,and
thereto answer unto Jeremiah Dono-
van. Jr., of said town of Norwalk, in
il- civil action wherein the plaintiff

1.—‘ he plaintiff is an elector and the
next to the largest tax-payer in Said
town of Norwa‘lk, and annually pays
about $500 taxes into the town treasury.
~2.—'l"ne defendants, Raymond, Baker
and Daskam are the selectmen of the
town of Norwalk, and the defendant
,Curtis is the treasurer of said town.
:3.—-'.l'he Board of school visitors of
said town is composed Of nine members,
to wit: Edwin Adams, Charles Olm-
stead. Abiatha Blanchard, George W.
Carroll, Edwin \Vilcox, John H. Light,
Frederick Mead, Bradley S. Keith and
Alfred E. Austin, all of said Norwalk.
t—By virtue of an act of the Gener-
al Assembly at its January session,
1893, it is provided that every town
haying ten thousand or more inhabi-
tants shall establish and maintain in
addition to the schools rrquired by
law, eveningr schools for the instruction
of persons over fourteen years of age
in such branches as the proper school
authorities in the town or district shall
prescribe provided that said act shall
not apply to any school district located
in the town which maintains such
school. :
5.——The said town of Norwalk has
more than .ten thousand inhabitants
and no school district therein has that
number of inhabitants and no separate
district is located in said town which
maintains such evening schools. '
6.—It is provided in said not that the
Board of School Visitors of said town
shall have the same supervision over
evening schools established in pursu-
ance of said act, as it is by law con-
ferred upon the school committees of
consolidated districts.
7.—'l‘he Board of school visitors of
said town in pursuance of law have
established an evening school for said
town in five departments and have ap-
pointed a superintendent of said even-
ing school and an acting visitor of said
school, and have voted to employ the
principal of the day school in each
of said departments as a teacher of
said evening school.
8.—The said selectmen Of the town,
defendants as aforesaid, without au-
thority of law and without consent of
card card of school visitors, have
assumed to employ one Brainard W.
Maples of said town of Norwalk, and
have employed said Maples to be the
principal of said evening school for the
ensuing school year at the expense ,of ~
said town of N orwalk. _
9.——-S_aid Maples is not qualified or
authorized by law to teach in said
evening school.
10.—The paid selectmeu have em-
ployed certain other teachers and threat-
ened to employ other teachers in addi-
tion to teach in said evening school

tend to, and unless prevented, by the
order of this Court, will maintain such
evening school and employ and pay
said Maples and other teachers In said
evening school from the public money
of said town of Norwalk and will draw
their order on the treasurer of said town
in payment for the expenses incurred
and to be incurred by them as aboye
set forth,and the said defendant Curtis,
will unless enjoined by the order of this
Court pay the amount of such orders to
the person in favor of whom the same
shall be drawn.

and Samuel Daskam, selectmcn of said
town of Norp'alk, and William A. Cur-

from paying any monies from said town
treasury on account of the several acts
of the selectmen set forth in the fore-
going com int in hiring teachers,

said petition are of a public nature and
that said motion should be granted and
that said injunction Should issue with-
out bonds, therefore, by authority of
the State of Connecticut, you, the said
town of Norwalk, and you the said Os-
car W. Raymond, ’l'allmade Baker and
Samuel Daskam, selectinen of said
town of Norwalk, and William
A. Curtis,treasurer of said town of Nor-
walk, and all of said town of Norwalk,
and each of you, your agents, servants
and attorneys, are hereby strictly com-
manded and enjoined under a penalty
of SLOOO that you and each of you, do
from henceforth absolutely desist and
refrain from paying any money from
said town treasury on account of the
several acts of the selectmen set forth
in the foregoing complaint in hiring
teachers and rooms or houses, and in
providing books, stationary and other
school apparatus for said evening school,
and from establishing and maintaining
an evening school in said town at the
expense of said town, until the Session
of the Superior Court to be held in and
for Fairfield county on the first Tues-
day of January, I894, and until said
Court shall make further order in the
