BOROUGH OF NORWALK.
CHAPTER I.
SEAL 0F 'rnn BOROUGH.
Be it ordained by the Court of Bummer of
the Borough of Norwalh :
The soul of the Borough shall be as hero
displayed :
and the same shall remain in the custody of
the clerk.
CHAPTER II.
BOROUGH MEETINGS.
Be it ordained by the Court of Bur-gum of
the Borough ofNorwalk: , .
SICTION l. The warden shall coll spccral
meetings of the borough when and for the
purposes directed by the court of burgesseo,
and shall do so by publishing every such
call, including therein a. statement ’of the
purposoo of the meeting, in the next luc-
cocding issue of a newspaper of the borough,
and shall appoint such meeting to be held
within five days after such publication
unless s-longer time be designated by said
court. .
SEC. 2. All meetin s of the borough shall
be hold in the N orwa k Town House unless
otherwise directed by the court of burgesaes,
and it shall be the duty of the bailifi' to
arrango the place of meeting therefor and to
be present thoreat.
SEC. 3. Any person who shall interrupt,
interfere with, insult, or refuse to obey the
reasonable direction of the presiding officer
at any borough meeting, or who shall by any
noisy, disorderly or quarrelsomc conduct or
longuoge disturb or interrupt such meeting,
shall upon direction of the presiding officer
bo taken into custody and confined by the
bailiff or any policeman of ‘ the borough
until tho adjournment of such meeting, and
shall furthermore be liable, upon conviction
of any such offence, to a fine of not more
than twenty-five dollars.
SEC. 4. Any person who shall in any way
fraudulently vote or attempt to vote at any
borough meeting, or who shall swear falsely
to any material fact before the board of
rogistration, or who shall in any way fraud-
ulently cause or attempt to cause any
addition to or erasure from any voting list of
’ the borough, or who shall fraudulently
abstract any ballot from or so deposit any
ballot in any ballot box used at such meet-
ing, or so add to or take from the
ballots cast at such meeting, or by any
fraudulent act or omission cause or attempt
to cause the casting, reception, counting,
returning or recording of any vote or
ballot contrary to law, or the rejec-
tion of, or failure' to count. return or
rocord any vote or ballot offered or received
in accordance with law, or who shall fraud-
ulently alter, mutilate, remove, abstract,
retain, conceal, destroy, or counterfeit any
ofiictal liot or record made by any officer of
the borough or any committoe appointed by
the borough or by the court of burgesseo,
and every person who shall aid, abet, coun-
sel, encourage or assist another in or to the
violation of any of the provisions of this
section, shall upon conviction thereof be
fined not less than twenty nor more than
fifty dollars.
CHAPTER III.
nnx'rmos OF THE COURT OF BURGEIIBS.
Be it ordained by the Court of Burgesles of
the Borough of Norwalk :
Sutton 1. The court of burgossel shall
hold regular meetings on the first Monday
of each month; from November to April
inclusive at 7:30 p. m., and at 8 p. m. in.
the other months; and may continue any
such meeting from time to time by adjourn—
mcnt.
SEC. 9. The wardon shall call special
meetings of the court of burgesses upon the
request of any three members thereof, and
If. such other times as he may deem neces—
sary. Every such cull shall bo in writing
and include a statement of the purposes of
the meeting, and shall be served upon each
bur-gees at least six hours before the time
appointed for such meeting by the
bailifi, or any freeman of the borough to
whom the sumo is directed by name, by
reading or copy in the like manner with
civil process, and the person serving the call
shall return the same with his endorsement
of urvice thereon to the clerk, or leave it
at his usual place of abode, at least three
hours before said appointed time. The
presonce of the warden or a burgess at any
opocial meeting of tho court shall be deemed
to heel any want of notice thereof to him,
and said meeting so far as every member of
the court of but-gasses so present is concerned
shall be deemed to be held under a proper
coll, duly served, to transact any business
which is brought before it.
SEC. 3. All meetings of the court of bur-—
gasses shall be held at the place appointed
y thorn, and whenever any change of place
is ordored the clerk shall immediately give
notico thereof to all members of the court
not present when such change was ordered.
CHAPTER IV.
orricnns.
Be it ordained by the Court of Burgess“ of
the Borough of Norwalk:
BECTXON 1. Tho court of burgersee shall
appoint an assistant clerk, a. surveyor, a
board of assessors, of three members, a board
of relief of three members, a chief
onginoor and two assistant engineers of the
fire department, a fire inspector, a. health
inspector, one or more poundkeepers, one or
more haywards, a. superintendent of sewers,
not loos than two or more than six police-
men of tho rogulor force, and such speciol
polioemon, not exceeding twenty -iive in
number, as said court may from timo to timo
doom best-
SEC. 2. The members of the board of
assessors and of the board of relief shall hold
office until the first day of January next
succeeding their appointment; all other
Officers appointed by the court of burgessel
shall hold office during the leasure of said
court. But no ofiicor shall e appointed or
removed by said court without the ascenting
vote of four burgessos.
SEO. 3. Whenever any person elected to
on office at any borough meeting, shall neg-
loct or refuse for one month after the com-
mencement of the term for which he may
have been elected, to take his oath of office,
or to give bonds as required by the charter
or by—lawo of the borough, the court of
burgosses may thereupon declare such Office
vacont and appoint another thereto if
within their power, or otherwise may order
a spocial olection to fill such vacancy.
8:0. 4. The bailiff shall give bonds in the
sum of five hundred dollars, and the collector
and treasuror in the sum of ten thousnnd
dollars each, with two or more sufficient
ouretieo approved by the court of burgesses,
conditioned to faithfully perform all tho
duties of their respective offices, and
answer all loss. cost and damage resulting
from negligence or unfaithfulness therein.
Said court of bur-gorse! my at any time call
for additional bonds, from any such officer,
when necoosary to make the amount of his
bond double the amount for which he is or
is likely to become responsible, and may
remove him from office upon neglect or
refusal to comply with any such call.
SEC. 5. Every person who shall wilfully
mist, hinder or obstruct any public officer
of the borough in the performance of his
official duty shall be fined not exceeding
twenty-five dollars, Iavo where a greater
pgnalty is authorized by the chartor of the
rough .
CHAPTER V.
Frumcss.
Be it ordained by the Court of Burgesses of
the Borough of Norwalk:
SECTION 1. No money, save as otherwise
expressly provided by the charter, shall be
paid from the borough treasury, except
upon written orders upon the treasurer
therefor expressly authorizod by the court
of burgesses and signed by the warden. but
the treasurer when acting in good faith
shall be protected in the payment of any
order, valid upon its face, if it be counter—
signed by the clerk of the borough. Such
orders shall specify so far as convenient the
nature of the claims-for which they are
drawn, and no order shall draw interest
unless specially authorized to such effect by
the court of burgeosos.
SEC. 2. Whenever it shall be necessary to
borrow money to pay any portion of the
indebtedness of the borough or its current
accruing expenses, the court of burgersos
may authorize IllClI borrowing in such
manner as they may then direct.
SEC. 8. All officers of the borough shall,
during the first two weeks of November in
each year, render full and detailed reports
in writing to the court of burgesses of all
monies received or disbursed by them dur-
ing the past year, together with ‘all other
proper information relative to their respec—
tive offices and shall render intermediate
reports of like nature whenever requested
bv said court.
'ch. 4. The treasurer upon receipt of any
moniol on account of the borough shall make
duplicate receipts, one of which he shall
give to tho ynrty from whom such money is
rcceivcd end the other he shall give to the
clerk. The treasurer shall keep his ac—
counts in such manner as to show the
receipts and disbursements connected with
the several departments.
CHAPTER VI.
TAXATION.
Be it ordained by the Court of Burgeares of
the Borough of Norwalk:
SECTION 1. All borough taxes shall be
laid by the major vote of a borough meeting
duly called and held for that. purpose.
SIC. 2. Whonevor a tax shall be laid by
the borough upon a list thereafter to be
completed, the clerk shall notify the assess-
ors, and the assessors shall forthwith insert
in three successive issues of n'newspaper
published within the borough, a notice to
all porsons liable to pay taxes therein, re-
quiriug them within thirty days from the
first publication of said notice, to give to the
mossors lists, verified by thoir oaths, of all
taxable property belonging to them on the
doy when said tax shall have heen laid, with
the particulars of all their proporty liable
to be , or voluod in the borough.
SEC. 3. At the end of thirty days from
the first publication of said notice, the
assessors shall meet at some suitable place
in the borough and make out a. list accord-
ing to their best; information and belief, of
all the taxable property Of every person
who has failed to give in a list as directed,
and shall odd to each of said lists the same
penalty as is provided by chapter one hun—
(1er and one, public acts of 1882, for neglect
or refusal to make out a town list.
SEC. 4. Within twenty days thereafter
the assessors shall complete the lists of the

It] ho etical order, and lodge them in the
o co ofthe clerk, and laid lists shall then
be liable to inspection by all persons liable
to taxation in the borough; and the assess-
or: shall have in all respects the same pow~
crs that assessors of towns have by law.
SEO. 5. Fifteen days after said lists shall
have been lodged by the assessors in the
office of the clerk, the board of relief shall
meet in some suitable dplace in the borough.

time and place of such meeting in a news-
paper published in the borough, and shall
receive such lists from the clerk, and hear
all appeals from the doings of the assessors
in relation thereto, and shall have the same
power to revise and add to such lists that
board! of relief of towns have by law; the
board of relief shall, within twenty days of
their first meeting return said list duly
reviled with their approval indorsed there-
on, to the clerk, and the rate bills shall be
made out therefrom by the clerk.
CHAPTER VII.
roman.
Be it ordained by the Court of Burgers” of
the Borough of Norwalk .'
SECTxON 1. The court of burgesses shall
appoint not less than two nor more than six
members ofa regular police force and not
more than twenty-five special policemen,
which latter shall act only as herein directed
and without pay, excepting as herein express-
ly nllowedmnd shall also appoint such officers
of the two forces from the members thereof
respectively as it. may from time to time deem
proper.
SEC. 2. It shall be the duty of the special
policemen to attend all tires in the borough,
to preserve order and the public peace and
safety thereat,to prevent all interference with
the firemen in the discharge of their duties,
and generally to then and there perform the
duties of regular policemen under the orders
and subject to the direction Of the warden,
the chief of police, the chief officer of the
fire department present and the officers of
said special force, in the order given; and
any member of said force who shall, while
on such duty, wilfully fail to obey any law-
ful order or direction given by a proper
authority shall be liable toa fine of not ex-
ceotling twenty dollars. Every special
policeman shall also whenever and for the
time directed by the warden act as and per—
form the duties of a regular policeman, and
while so acting shall be entitled to similar
pay; and any special policeman may with his
own consent be appointed and directed by
the warden to act, without cost to the bor—
ough, at any public gathering or assemblage
as a conservator of the peace with all tho
powers of a regular policeman for the time
being.
SEC. 3. It. shall be the duty of all polico-
men to obey all rules and orders which may
be from time to time prescribed by the
court of burgeslcs, and all lawful orders
which they may receive from the warden, or
the chief, or any superior officer of police;
and to preserve the public peace, and render
all possible assistance to the ministers of the
law ; and it shall be the further duty of the
regular police to report to the warden,
through their superior officer, all violations
of the state laws and of the borough by-lcws,
and all suspicious persons and places that
may come to their knowledge or observa—
tion.
SEC. 4. The regular policemen at all
times, and the special policemen while on
duty, shall have Within the borough, all
the powers of constables of the town of
Norwalk, relative to arrests and the pres—
ervation of the public peace.
SIC. 5. The court of burgesses shall pro-
vide suitable headquarters for the police
force, and shall proscribe a badge to be worn
by all policemen when on duty, and shall
provide a uniform for the regular force and
for the special force if deemed best.
SEC. 6. Any policeman who shall at any
time, whether on duty or ofi,becomc intoxi-
cated,‘or who shall at any time when on
duty. except by the order of his superior
officer, or to suppress disturbance. or to make
an arrest, enter into any drinking shop, or
saloon, or house of ill—fame, or who shall at
any time interfere in any caucus or‘ primary
election, or attempt to influence any voter
in voting at any public election, shall be
removed from his office by the court of
burgeooes.
SEC. 7. The warden shall supervise the
police force and keep himself §nformed by
frequent inspection of the manner in which
the several members perform their duties.
The chief of police shall report all deficien—
ctes or improprieticr by any member of the
force to the warden, and shall cause to be
kept a. record of all arrests, complaints for
violation of law, and information as to sue-
pected persons and places, which may be
made or given by the police, and shall
make a report of such record each month
to the court of burgesses. _
SEC. 8. The warden shall have power to
suspend front duty any member of the force,
but such suspension shall not continue for
more titan twenty-four hours unless the
warden shall, within such time, file with
the clerk of the borough, awritten statement
of such suspension and the cause for which
it was made. Such suspension shall
thereupon continue "until the court of
burgosses shall make further order in the
matter. No member of the police shall
receive pay for the time duringwhich he
may have been suspended from duty as
aforesaid, unless the court of burgesresmhall
decide that he was without fault in the
premises. And the warden may appoint
some suitable person to tempOrarily perform
police duty, in place of any member so sus-
pended, until the court of burgesses shall
make further order. , '
Spa. 9. No policeman shall charge or
receive, for his own benefit, any fee or
compensation, other than his regular pay
from the borough, for any services rendered
by him in his official capacity, or for any
services which might have been [0 rendered
by him. - -
SEC. 10. Every policeman of the regular
force before entering upon the duties of his
office, shall by a proper instrument, assign
and transfer to the treasurer of the borough,
for its benefit, all of his intorest and right
in and to any such fee or compensation
which may lawfully accrue to him from any
source during his official term; and shall
from time to time thereafter, as and when
requested by said treasurer, do and execute
any further acts and instruments necessary
to carry into offect the intent hereof. And
no policeman of said force shall be entitled
to any pay otherwise due him from the
borough until he lhlll have complied with
the provisions of this section to the sutisfnc -
tion of the court of burgesses. -
8x0. 11. Not oliceman shall receive any
present or rewnr for services rendered or to
e rendered by him in his official capacity
without the consent of the conrtof burgesses,
excepting ouch rewards as may be offered or
paid y public authorities.
CHAPTER VIII.

Silo. 2. Win-never any building or port
tbs-roof or addition thereto shall be (rooted

trict or removed into the same, in violation
of any provisions of section 1, the Warden
shall give notice in writing to the owner
thereof to remove the same from said dio-
triot and whenever any pero in after such
notice by the Warden shall fail to forth-
with rcmovo from said district any building
or art thereof or addition thereto, erected
wit in or removed into said district or in
process of erection therein, in- violation if
any provision of section 1, such _ person
shall, as provided in the charter, forfeit to
the use of the Borough the sum of two
hundrod dollars, and the further sum of
two hundred dollars for every' thirty days
of such foilurc to remove.
Silo. I. It shall be the duly of the fire
inspector to examine all premiers in the
borough whore‘he may have reason to sus-
pect that by any sons or omissions of any
person or in m any other cause any' propi
crty in exp led to unusual or improper
risk cf damage by fire ; and for such pur—
pose he may enter into any premises or
tho oocupont- of his business; exhibiting-his
badge of office, and requesting admission .
Whenever in tho opinion of. the FirC'In-
opoctor there is such unusual ,or improper
tions to the owner or occupant of suoh
premises for remedying the some and shall
limit the time within which it- shall be
done, and every person who shall prevent‘
the entrance or such Inspector. for the pur-
pooo of such examination into any premises
or building, or who shall refuse or neglect
to comply with his directions given as
aforesaid shall be fined not excel-ding
twonty-five dollars, but the Court of But—
gelsus may upon appeal disafiirm or mml-_
ify Inch directions or remit such penalty.
SEC. 4. Every person who shall kindle
or maintain any bonfire or burn any pile of
brush, leaves, straw, cornstalks, weeds or
othr-r combustible material in the open air
within fifty feet of any building, wooden
fence, lumber pile or other combustible
pr: iperty, unit-s: such building, fence. lum -
bar pile or OOIDbIlBtlblt! property belong in \
such person and is at least sixty feet dis-H
toot. from any other property expised to.
risk of injury by fire, without. spatial

and every person who shall kindle or main-

bonfire, or fire of any description in any
street, highway or public ground within the .
Borough shall be fined not exceeding
twenty-five dollars.
SEC 5. Every person who shall carry
into, or use wi thin any building where
hay, straw, shavings or any other highly
combustible substance is stored or exposed,‘
any lighted candle or lamp not; securely
enclosed in n. lantern. or any lighted segnr
or pipe or any other burning substance not,
safely enclosed, shall be fined not exceed-
ing twenty five dollars. .
SEC. 0. Every person who shall know-
ingly give a false alarm of fire in the Bor-
ough shall be fined not exceeding ten dol-
lots.
CHAPTER 1X.
GUNPOWDER AND sthan SUBSTANCES.
Be it ordained by the Court, of Burgesses of
the Borough of Norwalk :
SECTION 1. No pers in, without license
from the Court of Burgesses, shall sell any,
gunpowder, dynamite, nitro glyceriue. fire-
works Or other similar explosive substance,
or deposit, or keep, or suffer the same to be
kept in any place in the Borough, save not
more than one pound of gunpowder not
kept for sale. and fireworks not. exceeding
in value twenty-five dollars and not kept
for sale. And no person shall sell any gun-
powder to any minor under fiftei 11 years of
ego unless upon the written order of the
parent, master, or guardian of such minor.
Provided that the Warden or Fire Inspect-
or may give a license to any pers’tn to keep
so much gimp )wder as such person has
occasion to use in one day for blasting
rocks.
SEC. 2. The Court of Burgessrs shall
grant no license authorizing the keeping of
more than twenty-right pounds of gun-
powder in any one building. or of any nitro
glycerinc or dynamite except in 9. maga-
lino expressly constructed for such purpose
in such place and manner as said Court
shall have authorized and approved. And
every person licensed by said Court to keep
my explosive upon any premises Within
the limits of the Borough shall forthwith
notify the Chief of the Fire Department of
the exact: location where the some is to be
kept in or on said premises and shall keep
the same in no other place.
SEC. 3 Whenever any gun powder,
nitru glycerinedynamitefire works or other
explosive substance shall be found deposited,
kept. or Off-red for sale in the Borough in
vinlotion of the By-ans, it shall be tho
duty of the Warden to seizo and cause the
some to be removed to a safe place. and
unless the owner thereof shall within thirty
days thereafter pay to the Warden the
expense of such removal and storage. and
store the some scoot-ding to low. the War»
don shall cause the same to be a ild at pub-
lic auction, having posted a notice of the
time and place of ouch sale at least three
days previously on the sign post in the
Borough, and shall deposit the. proceeds in
the treasury; the balance after deducting
all expenses shall be deposited to the order
of the owner, but if not claimed within six
months f: om such n19 shall remain for the
use of the Borough
SEC. 4. Every person who shall deposit,
keep, or sell any gunp iwder, nitro glycer-
ine. dynamite, fireworks or other explosive
substance, in violotion of any of the pro-
vioionc of this chapter shall be fined not
exceeding fifty dollars.
SEC 5. Every person who shall with-
out a lioenso from the Wordon, or except
at such times as may be designated and
allowed by the Court of Birrgessesjflre any
connon, gun. pistol, or other fire-ornil, or
explode or burn any fire works or gun
powder or make or assist in making any
rook blast within the B-irongh shall be
fined not exceeding ten dollars.
CHAPTER X.
In]: Dnean’rr‘xs’r.
Be it ordained by the Court of Burgcases of
‘ the Borough of Norwalk:
Snortox 1. The court of burgeones
shall at all times maintain an organized
force for extinguishing tires, supplied
with suitable engines and apparatus.
Said force shall consist of nchicf engineer,
a first assistant engineer, a second assistant
engineer, one or more engine companies,
one or more hose companies, and one or
more book and ladder companies. Each
of said companies shall consist of not more
than thirty active members voluntarily
enlisted for not less than two nor more than
five years, and shall annually elect bya
mljor vote of its activo members, a foreman
and a. first and second assistant foreman,
subject to approval by the courtof burgesses;
and may enact by-lnws for its own imme—
diate government subject to the like
approval, and not contrary to the by aws
or the charter of the borough. Said court
may at any time remove or discharge any
member of the force; and the chief engineer
may, with the approval of the warden,
discharge an member not an officer.
SEC. 2. t shall be the duty of all
members of the force to be present at all
fires. The assistant engineers and assistant
forcmcu shall at all times aid their respective
superiors in the performance of their duties,
and in the absence or inability of the latter
shall have all their powers, duties and
privileges.
SEC. 3. The foreman of each company
shall have the immediate command thereof,
and the immediate care of all borough
property used by such company. He shall
eep the some in readiness for immediate
service, and shall call out his company at
lust once in each month, from April to
November inclusive, and at such other times
building in the day time, after informing .7

Site. 4. The chief engineer shall at least

ized to appoint half I; to the approval of

alarm system whose duty it shall be to care
for and maintain the-game under the direc-

wise expressly authoifized by said court. He

said companies or either of them as he may
deem best He shall cause a record to be
kept of the proceedings of every such meet-
ing and shall report to the court of burgesses
any such conc usions thereof or matter:
considered thereby as he may deem proper.
He shall annually call out the entire fire
department for ihspection and review, and
shall at all timOI keep himself informed as
to the efficiency of the several companies.
He shall see that all regulations for the
govemmcnt of the fire department are car-
ried into effect, and thall in the month of
November of each year, and at other times
when directed by the court of burgesoes,
rondor a detailed statement in writing, to
said court, of the condition of the fire do—
psrtment. He shall direct all operations
for extinguishing fires, and shall be indem—
nifiod by the borough for all damage that
may accrue to him by reason of the destruc-
tion of property destroyed with the approval
of the war on to prevent the progress of any
fire. .- '
SEC. 5. Upon the breaking out of any
fire in the borough, it shall be the duty of
each member of a company to repair to tho
place where its engine or apparatus is keg?"
and to proceed_with the same to such ro
and to remain under the direction and
obey all lawful orders of any superior officer
until dismissed by such superior. _
SEC. 6. The chief engineer and. his
assistants shall have all the powers of officers
Of the police while going to, being pre=ent
at, or returning from any fire in the borough.
SEC. 7. Every member of the fire de—
partment who shall disobey any lawful order
of a superior officer with reference to the
performances of his duty, and every person
who being present at any fire, shall do any
act contrary to the command of the senior
engineer present, shall be fined not exceeding
twenty-five dollars. Provided, that the
court of burgeeses may remit any penalty
imposed under this section.
SEC. 8. Every person who shall take or
assist in taking any fire engine or other firo
apparatus, or any part thereof, belonging to
the borough, beyond the limit: of the
borough, unless by order of the foreman of
the company to which Inch engine or
apparatus has been assigned, or of one of the
engineers of the fire department, shall be
fined. ten dollars, and every such engineer,
foreman, or assistant, who shallgivc such
order without the previous approval of the
warden, shall be fined fifty dollars.
SEC. 9. The court of burgesses shall
from time to time prescribe such detailed
regulations for the government of the fire
department as llld court may deem neces-
sary.
CHAPTER XI.
POUNDS AND SIGN roar.
Be it ordained by the Court of Burgesses of the-
Borough of Norwalk :
Sharron 1. The court Cfburgcsses shall
cause to be maintained, at the expense of
the borough, a sufiicieutpouud or pounds,
and every person shall have the right, and
it shall be the duty of every hayward to
take up and impound thcroin all horses,
mules, cattle, goats, sheep, swine and
geese which may be found going at. large
within the borough. The fees for im-
pounding sholl be fifty cents each for
horses, mules and cattle ; twenty-{lye cents
each for goats. sheep and swtne, and ten
cents each for geese, to be paid by the
owner thereof to the pound—kcopcr, to-
gether with all reasonable oxponsos for
food and drink supplied to such animals
while impounded. Such fees and expen-
ses shall be paid before such animals are
released from pound, and the pound-
kecper shall pay over one —holf of such fees
to the person driving such animals to
pound.
SEC. 2. The pound-keepershlll supply
all animals impounded with proper food
and drink, and, if no owner shall appear
within forty-eight hours after such im-
pounding, to redeem or replcvy the same,
the poundkeeper shall post a notice of
such impounding, describing the peculiar
natural or artificial marks of each such It]-
imal,on the sign postin the borough, andin
the case of horses, mules and cattle shall
publish such notice also in a nowspupcr of
the borough, and shall sell at public
auction at the pound all such horses,
mules and cattle at the expiration of
twenty days from the time of such publi—
cation, and all such goats, sheep, swino
and goose at the expiration of ten days
after such-posting as aforesaid, the came
not having been replevied or redoemed
by payment of the poundage fee and ex-
penses of keeping, poltingnnd advertising
such animals, and shall deposit the balance,
after deducting such fees and expenses,
in the treasury of the borough, and if the
owner of such animals shall not claim
such balance within one year from the
time of such sole, it shall remain for the
use of the borough.
SIC. 8. Evory person who'sholi rescuo
any animal liable to be impounded, out of
the custody of any person or persons
driving the some to pound. or attempt to
prevent any such person from driving the
lame to pound, or shall break the pound,
or take therefrom any animal without
permission of the pound-keeper, or by
due process of law, shall be fined not ex-
ceeding ten dollars.
SIC. 4. The sign post of the town of
Norwalk within and nearest tho centre of
the borough shall be the, borough sign
post.
CHAPTER XII.

Be it ordained by the Court of Bur-guru of
the Borough‘ of Norwalk .-
Sxortox 1. It shall be the duty of tho
chairman, for the time being, of the com-
mittee on hi hways of the court of bur-
geueo, to o serve the condition of all
streets, highways and public grounds of
the borough, and to keep the same cloan
and in propor repair undor the direction
of said court.
8x0. 2. It shall be the duty of every
owner, lessee and occupant of any land or
tenemcnt in the borough to keep the
public sidewalk and gutter adjoining tho
some free from snow, ice, weeds and other
obstructions; and every such owner, les-
Icc onoccupont, who s all permit snow,
ice, weeds or other obstruction to remain
on such sidowolk to‘ the inconvenience of
public travel thereon,orin such gutter so as
to obstruct the flow of wator therein, for
a longer period than six hours, shall be
fined not exceeding five dollars.
Sec. 3. It shall be the duty of the
chairman, for the time being, of said
committee on highways, whenever any
snow. ice, weeds, or any obstruction is
permitted to remain on any sidewalk or
in any gutter adjoining the same in viola-
tion of the foregoing section, to cause the
same to be removed, and the expense of
such removal moy be recovered of any
such owner, lessee or occupant in an
action brought in the mine of the bor-
ough, and shall be independent of any fine
imposed by virtue of the foregoing section.
BIG. 4. Evory person who shall movo
or assist in moving any building into,
upon or through any strcoi, highway _'Ot‘

special license from the court of bur-gasses,
shall be fined not exceedingjflfty 'dolhm.
BIG. 5. No person shall open or con-
tinue opon to the public any new street,
highway or alloy without license from
the court of burgcsses, or make or con-
tinue any sewer, drain, gutter or ditch,
discharging upon any street, highway or
public groun , without such license, or
make or continue any sidownlk, gutter,
curbstone or guard rail in violation of, or
not conforming to such grade, line, speci-
fications or regulations as may have been
prescribed therefor by the court. of bur-
gesseo, or make or continue any opening,
steps, cellar-way, step-way or coalholc
under or upon any sidewalk or any part
of any street, highway or public ground,
unless a solid, substantial and well-secured
cover is maintained over the some, 'or
unless by special license of the court
of burgcsscs, or erect or continue any
post on any sidewalk or other part. of any
street or highway without such license,
or erector continue tiny building. fence
or wall, or arty part thereof on any high-
way, strcctor public ground, or make any
excavation or embankment, or continue
the same in any street, highway or public
ground without license from the warden,
or deposit or continue any gas pi e, tim-
ber, lumber, sionc, brick. sun , limo,
mortar or other building material on any
part of (my street, highway or‘ public
ground without license from the warden,
or carry on any trade or business in any
street highway or public ground without
license from the warden. Every person.
who shall violate any of the provisions of
this section shullbc fitted not exceeding
twenty dollars. Provided, that such pen-
alty shall not be imposed for any such
continuance, until after oral or written
notice to the person so offending, by the
warden, borough attorney or chairman,
for the time being, of said committee on
highways, that the some is contrary to the
by-laws of the borough; and every twenty-
four hours of such continuance after such
notice, shall constitute a separate and
complete offence.
Sec. 6. If any person shall, without
license from the warden, lay or cause to
be laid, or to remain, any stones, timber,
wood, rubbish or any other thing in any
highway, or public ground within the
borough, or shall di up the ground, or
Setupt‘ir‘caus‘c to retttain any gates, bars,
rails or fonce in or across any such high-
way or public ground, or erect or con—
tinnc any building therein by which such
highway or public ground shall be an-
noycd or in any way incumbcred, the
same shall be deemed a common nuisance
and may be removed as such by the
bailiff or any proper borough official after
reasonable notice; and the expense of
such removal may be recovered of such
person in an action in the name of the
borough; and every such offence shall in
addition be punishable by a fine of not ex-
cocding fifty dollars. _
SEC. 7. No person shall within the
limits of any highway, street or public
ground in the borough, do any of the
following acts: deposit or continue, ex-
cept for tho purpose of transit and deliv-
ery, and for such time as may be neces-
sary therefor, any coal, wood, goods,
wart-s, merchandise, furniture,|machinery,
packages, boxes, barrels, crates, or any
substance or article which may in any
waycndanger, interfere with or rcntler
less convenient the public travel ; or erect,
suspend or continue any sign, banner,
flag or advertising device, or any goods,
wares or merchandise, upon or on r any
street, highway or public ground without
license from the warden; deposit 01'
continue any garbage, offal, slops, swill,
ashes, shells, filth, refuse, dead animal,
shavmgs. paper, straw, grass, weeds,
stones, brushwood, limbs of trees, or any
noxious, offensive, or uuwholesome ar-
ticle 01' substance; ride or drive any
animal or vehicle, or run any railroad
train or hand car at a rate of speed greater
titan six miles an hour within the fire
limits, or eight miles an hour Without
snchtlimits; throw or pitch any ball,
stone, rock, snow bull or missile of any
description into, over, or upon any part
of any street, highway or public ground;
slide down hill or coast with sleds ; drive
animal to sleigh or sled without bells;
hitch any horse or inuic to any tree in
front of the premises of another; per-
mit any animal or vehicle to stop
or stand upon or over any crosswalk while
having the control of such animal or
vehicle ;- turn leuso or permit any animal
to go at large; draw or assist in drawing
any fire engine or fire apparatus along any
sidewalk; ride or drive any animal along
any sidewalk ; draw or push any lmndcart
along any sidcwnlk ; run, ridc,usc or drive
any velocipedc, bicycle, tricycle or similar
vehicle in,upon oralong any sidewalk; per-
mit anylimb or branch of anyircc or shrub
to overhang any part of a highway within
twelve feet of its surface, being the owner
or occupant of the adjoining premises,
and having been directed by the warden
or street inspector to remove such limb or
branch; wrestle, scufilc. brawl, fight or
quarrel; use any profane or indecent
expressions or make any boisterous or
tumultuous nonsc, insult or annoy any
person passing by, or any intoxicated
person, or wantonly remove or assist in
removing the gate of any other person’s
enclosure; congregate with crowds or
groups, or stand idly or loaf on any
sidewalk, to the Obstruction or annoyance
of the public travel. Every person who
shall violate any of the provisions of this
section shall be fined not exceeding five
dollars; Provided, that such penalty shall
not be imposed for any such continuance
until after Written or verbal notice to the
person so'ofiending by either the warden,
borough attorney, or any police-
man that the same is contrary to the
by—lsws of the borough, and every
twenty-four hours of such continuance
after such notice shall bc a separate and
complete offence. '
SEC. 8. No person having a freehold
estate In any land or premises within the
borough shall suffer to remain or c0ntinue
thereon any embankment, pile of dirt or
stones, wall, building, or structure, of any
kind adjoining any sidewalk, highway, or
public ground, in such a condition as to
interfere with or endanger the public use
thereof or travel thereon, or so its to make
such sidewalk, highway or public ground
inconvenient or unsafe in any way or to
any extent; and every twenty-four hours
of such continuance shall be a separato‘
and complete offence, and every violation
of any provision of this section shall be
punishable by a fine of not more than
twenty—five dollars.
SEC. 9. It shall be the duty of every
person having a freehold estate in any
land or premises in the borough adjoining
any sidewalk, highway or public ground
to prevent by proper means the falling or
washing of sand, dirt or gravel from said
land or premises on to such sidewalk,
highway or public ground in any such
manner as to impede or annoy the public
travel thereon. And every twenty-four
hours of neglect of the duty herein im-
posed and prescribed shall be a separate
and “complete offence, and every such
offence shall be punishable by a fine of
not exceeding ten dollars.
SEC. 10. The warden, built}, or any
burgcss or policeman shall have author-
ity, and it shall be the duty of
every such officer, whenever any street,
highway or public ground, or nui-
part thereof, is obstructed in the 5view of
such officer, by vehicles, animals, or
crowds or groups of persons, or persons
standingidly or losfing on any sidewalk,
in view of such officer, to direct all per-
sons so crowding or grouping to move on
or disperse, and to direct all ersons hav-
ing the control of such snimn s and vchi-
cles to Withdraw the some in such direc-
tion as such officer may indicate, and to
direct every person so standing idly or
lonfing on the sidewalk to move on, and
every person disobeying any such direc-
tion shall be fined not exceeding five
dollars.
SEO. ll.~ Every. person who shall
without a special [memo from the warden
stand any wagon, cart orxvcliiclc, or set
up any pcdler's, huokstcr’s or trader’s
stand, for the sale of any article of food
or any goods, wares or merchondiso
therefrom, in any street, highway or
public ground in the borough, shnll be
fined not. exceeding ten dollars.
SEC. 12. Any person who shall sell or
expose for sale at auction any goods,
wares, merchandise or property of any
kind in or on any highway or public
ground within the borough, excepting at.
the borough sign post, shall be fined not
exceeding ten dollars.
SEC. 13. No special license granted by
the court of burgcsses or any officer of the
borough shall have any other effect than
'to protect the person or persons to whom
the same may be granted from the penalty
otherwise imposed by the borough by-
laws; and shall have such effect. only
provided such person or persons shall set
thereunder in a reasonable and prudent
manner. and use all due precaution for
the protection of public and private prop-
crty, the safety, comfort antl.'hcnlth of the
inhabitants of the borough, and the safety
and accommodation of the public travel.
Any such license may at any time be
revoked by either the authority grunting
it, or by the court of burgesses.
SEC. 14. No license to deposit building
material shall in any case authorize the
obstruction of the guitar or ditch of any
street. or highway, or the obstruction of
more-than one fourth Of the width of the
street or highway, between the gutters or
ditches, or the obstruction of the side-
walks, so as to lenve less than a clear way
six feet wide along such sidewalk.
SEC. 15. The court of hurgcsscs shall
make such rules and orderswith regard to
the lighting of the streets, highways and
public ‘grounds,‘nt the expense of the
borough, as said court may from time to
time deem expedient.
CHAPTER XIII.
. WATER WORKS. .
Be it‘ordained by the Court of .Burgesus of the
Borough of Norwalk .-
SECTION 1. Every person who shall
and every person who
violate any of the-rules and regulations
heretofore made or which may hereafter be
made by the Water Commissioners Of the
Borough regarding the use and dis'ributioo
of water by means of the Water Works
constructed and maintained by the Bur
ough, or who shall neglect or refuse to
p 'rform any duty imposed upon him under
or by any of said rules and regulations,
and every person who shall be guilty of
carelessness, negligon co « ~r w ilful misconduct
whereby or in consequence of which any
of the reservoirs, water pipes, hydrants or
other apparatus, fixtures or property of any
kind connected with or appertaining to the
said VVator Wo its shall no in any way
consequence of which any loss or damage
shall result to the Borough on amount of
or in cwnnection with said Watt-r Works,
shall, in addition to any fine or other pen-
alty which may be imposed, be liable to
pay juut (lainagvs therefor tn the t casurer
of the water fund for the use . f said "fund.
And all actions which may be brought in
behalf of the Born-ugh to recover any d» be,
damage or other thing in demand, relating
to or on account of said Water Works or
the supply of water therefrom or for any
injury thereto, shall be br fight in the
name Of said treasurer for the use of said
fund.
SEC 2. If any person not licensed there-
to as hereinafter provided or if any such
licensee without 1 special permit therefor
from the Water Com nissiouers, shall top,
or make any connection“ with any otroot ,5
main, service or other distributing pipe, or
with either of the reservoirs, whereby any
water is or may be taken, drown or con-
ducted lrom the Water Works, or shall by
any [mans divert or conduct water from
said Works, or shall make any addition to
or alteration of any water pipes, fixtures or
apparatus, whereby a greatersquantity of
water does or may flow than is allowed by
the permit therefor, or whereby such water
is or may be applied to other uses than are
allowed by such permit, such person or
persons so offending shall be subject to a
fine of not more than fifty dollars.
SEC. 3.. Every plumber or other person
wishing to do bu~iuess in connection with
the Wa'er Works of the Borough must
procure a. license thereto from the Water
Commissioners, and. execute a. bond to the
Borough in the sum of five hundred dollars
conditioned that he shall indemnify and
saw: ‘harmless the Borough and said
Commissi note from all suits and actions
of any name or descripti .n brought against
it or any of its officers for or on account of
any inju‘ms or damages received or sus-
tained by any person by or from raid li—
censte, his Servants or agen s m (lair-g raid
work, or by or in consequence of any neg-
ligence in guarding the some, or any im-
proper materials used therein, or by or on
account of any act or omission of the Ilid
licensee t 1‘ his agents; and that said licensee
shall faithfully perform the work in all
respects, and shall til-i.) replace and restore
the street pavement ovcr every opening to
us good sta r. and condition as he found it;
out kzep and maintain the some in good
order to the satisfaction of said Commis-
sioners. fir the space of six month there-
after ; and shall also comply in all respects
with the rules and regulations established,
relating t > sairl Water Works; and also
that he will pay all fines imposed upon him
for a violati m of any lawful rule or reg-
ulation with refer-t nee thereto.
SEC. 4. If any person shall, without the
consent (.f the Water Commissioners,
turn on water, so that the same shell or
[tiny fl w or be supplied in or upon any
place whrrc the same has been shut Off or
withheld by or by order of the Water Com-
missioners, pursuant. to law or to any rule
or regulation of said Commissioners, such
person so offending Elm-ll be subject to a.
line u f not. less than five nor more than ten
dollars.
SEC. 5. If any person shall i bstinct
free access to any public fire hydant or
stop-cock, or shall, without permission
from the Water Commisstoners, drow, con-
duct or use any water therefrom, except. in
case of fire, or shall without such permis-
sion ()prn or intermcddlo with any such
public hydrant or stop cock, such person no
offending shall be subject to a fine of not
less than five nor more than twenty dollars.
Slot 6. If any plumber or other person
who shall set up ul‘ construct, in or upon
any private property, any pipes, fixtures
or apparatus for the. use or water from said
Water Works which shall be so connected
with said Works that the water therefrom
does or may fiowfin or upon such property,
shall refuse, or without reasonable excuse
shall neglect to make report. thereof in
writing, within five days, to the Woter
Commis-ioncrs, stating all the particulars
in relation thereto which are or may be
required by the rules and regulations of
said Commissioners, or if any plumber, or
other person shall neglect or refuse to
make report in writing to said Commis-
sioners during the first wed: in any month
of an connections and extensions of service
pipe made by him during the preceding
monthsard not before so returned, giving
the location of the premise, the name of
the Owner or occupant, the character of the
work,‘ the number of hydrants, bsthg,
water-closets, fountains, faucets, cooks.
hose fixtures, and other fixtures Ind appor-
ntus of every kind whatsoever connooiod
with such Work s, such plumber or other
pen-on so neglecting or rtfusing, shall be
subject to a fine of not less than five nor
more than teenty dollars,
Sec. 7. Every person who shall place,
throw or depos 1: any rubbish, filth or any
substance whatever in or into either of the
reset-vars, pipes or other receptacles of slid
water,or in any way pol .utc. corrupt or render
unwholesome the water the rein, or shall
suffer or permit any fowl: or animals
Owntd or kept by him to go into, swim in,
or in any way pollute or curmpt said water
and every person who shall launch, put or
place any raft, boat; or other craft upon the
water in either of said reservoirs. or who
shall sail, row or ride therein or thereon,
shall removo
or attempt to remove any ice from. or
shall catch or ottempt to catch any fish in
or from, or shall swim or bathe in said
reservoir or either of them, shall be subject
to a. fine of not less than five nor more than
twenty dollars.
SEC. 8. Every person who shall wilfully
violate any rule or regulation of the water
commissioners in any matter not herein
specially mentioned and provided for, shall
be subject to a fine of not, exceeding seven
do lars.
SEO. 9. It shall be the duty of the
borough attorney to prosecute all offences
