Oyster Laws.
The law forbidlng the taking and gath-
ering of Oysters from the first day of April
until the fifteenth day of October. in each
year. was repealed by the last Legislature.
The following is the oyster law of 1878 with
reference to non-residents:
“ No person shall take. rake or gather
any oysters in any of the rivers. bays or
waters of this state. on board of any canoe.
flat. smw. skiff. boat or vessel. for any em-
ployer who is not at the time and for the
palm! of six months next preceding has
not been an actual inhabitant or resident of
this state. on penalty of twenty dollars. one
half to the treasurer of the town where the
«rm-nee is committed. and the other half to
him who shall prosecute to ellbct.“
It is also provided that any boat or veuel
of any description so used by such person
shall beltable to be coined by any ohorifl.
constable, or man reason. and the ofloer
or person so seizing shall give notice to two
Justices of the Peace of the town who are
to make an order for the detention of the
vessel or boat. and give notice to the owner
nr one in posession. of the tune and place
appointed for trial. And if at the trial it is
proved that the vessel or boat belongs to a
nonresident as above set forth. the vessel
or boat is to be forfeited and may bacon.
