which he presented yesterday. he at-
tempted to meet this situation.
Asserting that there should be no
positive denial of justice to those
whohave relied in the past on the
validity of certificates. Mr. Blodgett
~declares that injustice will result in
some cases “from the indiscrlmln-
at. actbn or the collector" if he
proceeds to collect on assessments
reduced; "which he is now Justified
in doing"
On ti. other hand. Mr. Blodgett
points out. the collector may feel in
the tuturo that lie is under official
obligation to proceed with the col-
lection of money due the city and
not paid by season of issuance of
certificates.
Undoubtedly the Supreme court
would have given the Bridgeport
Brass company. the plaintiff in the
certificate of error lest suit. oppor~
tunity to be heard on the merits of
its case. ‘iir any warrant of law for
doing so could have been found,"

CHICAGO. April 16.-—Russell
Scott. once rated as a. millionaire
bridge promoter in Detroit and
VVlndsor. was placed in the death
cell yesterday to await .his execution
tor murder Friday.
All efforts to obtain a . reprieve
from Governor Small failed. and
only the intervention or the Su-
promo court tomorrow or the sen-
tencing judge can save him from
the gallows. Both eftorts will be
pressed. his attorneys declared to-
day. The Supreme court has Scotts
lengthy petition before it but failed
to consider it yesterday. recesslng to
today the eve of the execution.
Scott. high in hopes even in the
face of his sentence blanched when
informed that Governor Sniali had
refused to intervene. He grew ner-
vous and sought to steady himself
in cigarette smoking as he prepared
for his removal to the death cell.
Because of his threats that. he
never would hang. it ms feared
that Scott would attempt to end his
own life. It was this fear that
prompted the authorities to put him
under heavy guard for a- longer
time than the usual ‘24 hours before
execution.
“I'm confident the Supreme court
will give me a. stay." Scott remark-
ed to his two guards who are con—
stantly with him.
He made no request for a spirit—
ual adviser for what appeared to
be his last hours.
Scott was convicted of participat-
ins with his brother in the hold-up
