Stamford City Court was upheld by
Judge John B. Booth. Upon the
filing of notice of an appeal to the
Supreme Court of Errors. Judge
Booth granted a stay of execution.
On a charge of selling liquor
O'Brien was acquitted, the jury re-
fusing to accept certain testimony
introduced by the state. Following
the appeal. taken on the question of
the legality of the first verdict.
O'Brien was released under bond of
$2.000.
When first retiring. the Jury was
out for one hour and a. half. and re-
turned to announce a disagreement.
Judge Booth read a further charge
and sent the Jury back. The second
time a verdict was returned in fifteen
minutes.
Prosecution of O'Brien was hand-
led by Prosecuting Attorney Fred-
erick W. Huxtord. who discredited
O'Brien's story through cross-exam-
ination. One of the climaxes o! the
trial was reached when Mr. Huxtord
took from a bottle of liquor which
nrgga 1.1.5.394 lead man
before prohibition, a newspaper dat-
ed November, 1923.
The allure of the Jury to convict
O'Brien on the selling count was
due to the inability of one ot the
state‘s chic: witnosaeee. David H.
llarkowlts. to convince them that an
actual sale had taken place. ’
narkowita. who claims to have
bought liquor Irons O'Brien with
money given him by Detective aer-
gea-nt George McCarthy or the Siam-
tord police department. testified to
the alleged nan-lotion on the wit-
uon'stand. but his story did not car-
ry weight with the jury.
