If it worked and proved con-
stitutional. it might be beneficial.
Many petitions have been flied
with the Tariff Commission under
this flexible provision. but no final
recomixiendation has been made to
the President or action taken by
tho President. Thus far the section
is a. dead letter.
However. the constitutionality of
this so~calicd flexible section will be
settled by the. Supreme Court of the
District of Columbia. Action has
been started by the impprung
agents of a foreign producer of sod-
ium nitrate in New York city, to
compel the Tariff Commission to
permit inspection of an application
tiled by an American producer of
sodium nitrate for an increase in
the import duty on that article.
It is expected that the decision
will involve the constitutionality of
the entire flexible section. It may.
however, so to tho'Uuited States
Supreme court.
There is great interest in this
matter particularly on the part of
importers who are planning to
storm the Tat-int Commission and
the President with petitions for re-
ductions of duties. in case the lsw
stands.
The Tariff Commission is divided.
one-halt in favor of the flexibls pro-
vision and one-half oppoued.
So long as a protectionist uh
President Coolidge is in the White
House there will be little danger of
reductions in protective duties: but
it a free trader or low man‘
