Seeks Receiver
Claiming that the assets of the com-
pany are. in danger of waste through
inlsn1anugemvnt. the appointment of a
receiver for the Trix Cereal company
is asked for by Arthur J. Dickinson
and E. E. “‘ilson of New York.
through the office of Tammany 8r
Connery.
It is claimed that the plaintiffs are
large on ncrs of stock in the defend-
nnt company. and it is alleged that
the defendant company has not paid
taxes on its real estate holdings here
for upwards of .ten years. and that the
(ity is threatening to foreclose on
liens of said company.
Allegations are also made that al-
though the land and buildings are
only assessed for $5,600 on the city's
hooks. they are carried on the balance
sheets of the company. as per a state-
"tent of April 1. 1023. as being worth
$43,000.
It is further alleged in this petition,
papers in which were served by Con-
stable Bryan Silk yesterday. that the
company owes a number of bills and
that the creditors are threatening at.

It is asked that a received be ap-
pointed of the. property. rights. and
good will of the corporation in Con-
necticut. with power to dispose of the
same and to collect all debts for the
benefit of those people who are en-
titled to them.

Sterling garage on the Turnpike near
the Darien-Norwalk line. is named as
defendant in a suit for the foreclosure
of a mortgage hold by Len Baron of
Stamford. in which the Firestone
Tire 8-. Rubber company. the Mason
Connecticut Light a Power Company
are also named co-defendants. because
of attachments they hold on the prop-
erty in question. The case is return-
able to the June term of the Court of
Common Pleas. and a foreclosure and

Inst Presentation of “You Can't Fool
Your Wife”
The Regent Theatre will present for
the alst time today the Paramount su-
per special production "You Can't.
Fool Your Wife." This big attraction
with Leatrico Joy. Nita Naldi and
Lewis Stone. is one of the most pre-
tentious Paramount releases of the
year. In the showings that it has al-
rcady had in Norwalk it has created
a. big hit. ‘

What constitutes a clever com-
sdian?
Is it a funny face? A 'funny cos-
tume? Funny actions or funny lines?
The answer is both yes and no.
According to life-t Bertrand. fea-
tured comic. producer and stage man-
ager of Lewis Talbot's, spectacular
production. “Wine, Women and Song"
playing at the Palace Theatre today. a
comedian is all of those and more.
This evening's show will be at 8:15.
"Making the public laugh is a. seri-
ous task," said Bertrand solemnly.
when interviewed recently. “M‘bre~
than that it is a privilege. and those
who pass over their work in a. careless
manner. or do not put the proper
thought behind their work are both
cheating the public and their em-
ployer.
“To be a good comedian. a. man
must be a. student of human nature.
He cannot conjure a fantastic creature
out of his own mind and expect it to
be funny. True. such a creature
might draw a few laughs from its
sheer impossibility but it would be-
come tiresome. The real humor of
life is in life itself. The character
that creates laughter. without drawing
down ridicule is the one that endures.
I impersonate an old Hebrew whom I
met on the East Side of New York
many years ago; a lovable old charac-
ter who could mangle the mother
tongue in great shape. Curious as it
may scund. l have not exaggerated
his characteristics greatly. neither
have I tried to bring him up to rid-
icule. ,
Give a good comedian. one who has
a sense of humor, a poor line and he
will make a. good one: give a poor
comedian a good line and \‘icc-vcrsa.
There you are! It's like everything
else. it's the man that makes the part.
not the part that makes the man."

The final showing of "Within The
Law" featuring Norma Talmadgc will
be held this afternoon and evening at

edy. entitled “Boys' to Board." which
features that very clever gang of kids
that Hal Roach has made famous.
Tomorrow evening VV’csley (Frec-
kles) Barry will be feaured in “Heroes
of the. Street" a tale of New York
city that affords him many possibil-
ities for displaying his own inimitable
style of acting. This picture will be
shown Monday and Tuesday as well.

Contractor Seeks
$10,000 Damage
for Injuries
Clarence l. Finch. contractor of
East Norwalk. has started suit.
against Albert D. Morgan. \Vashing-
ton street hardware merchant in the
Superior court. June term, for dam-
ages of $10,000. as the result of in-
juries sustaincd by him. when on
June 10th, 1922. he fell down an ele-
vator shaft in the Morgan store.
The plaintiff alleges in the writ. pa-
pcrs in which were served yesterday
afternoon by Deputy Sherifl Edward
B. Doulens. the action being started
through Tammany A: Connery. that he
entered the defendant's store to pur-
chase some wire, and was requested
by Morgan i. go upstairs and see
what he had in stock. 1
Finch further alleges that he saw
the elevator door open. and knowing
that the elevator was the usual cmans
of going upstairs. walked in. There
were no lights and he believed the
elevator was at the floor. However,
it was not at the first floor and Finch
fell down the shaft. sustaining a brok-
en hip. which it is claimed will be
perman tly injured. together with
cuts ad rulses which confined him
to the Nor-walk hospital for over two
months.
It is claimed that the accident was
the result of carelessness on the part
of Morgan or his employee. Attach-
ment of property to the amount of
$12,000 was made yesterday by Sher-
