Explain Contradictory
NEW HAVEN, April 6.-—-Sutfering
a severe grilling at the hands 0! Carl
1-]. \Vhitney and Benjamin Slade, rep-
resenting the members of the famous
so-called Delchery conspiracy to vio-
late the \‘oistead act. Saul Grill, gen-
eral prohibition enforcement agent of
\Vushington, became badly confused
on the witness stand today and gave
testimony which was said to be in
contradiction of that formerly given
by him before a. United States com-
missioner.
Grill. consciously or unconscioule.
had been evading direct answers to
Mr. Slade's questions during the long
session and Judge Ilowe's patience
gave way.
"There is no reason for not an-
swering the questions Mr. Slade
, asks.” he said. "I want you to answer

1it. Furthermore. I am going to give
Mr. Slade all the latitude he requires
in his examination."
The case was continued today fol-
lowin: adjournment yesterday when

resenting Edward Derigibus. Freder-
ick L. Kirk and John Krauter of
Bridgeport. Michael Delohery, Jr" of
Darbury and William J. O'Brien of
Stamford was denied by District
Judge Harlon B. Howe. The session
this morning was taken up in the
cross-examination of Grill.
Attempts made by M}. Slade to
show that the prohibition agent had
been formerly engaged in the liquor
business fell flat. Grill testified that
he had never been connected in any
way with the liquor business.
Upon questioning by Mr. Whitney.
of New York, Grill admitted that the
actions of "Captain Charlie" scan-
dalus. who consummated the sale of
liquor. was a. pretense and that Grill
had Seandalus arrested in the Strut-l
ford hotel at the same time the de-l
tendanis were arrested. as a part of
the plan.
"You admit that this pretense was
a part of the scheme?’ 'asked Whit-
ney.

Mr. Slade. in questioning Grill.
asked what his home address is in
New York. Assistant District Attor-
ney, prosecuting the case of the gov-
ernment. objected to the question on
the ground that it was immaterial
and that the nature of the witnes'
work was such that to tell his ad-
dreu would be contrary to good pub-
lic policy.
“This is a. most extraoralnl'ry point
in law/v said Mr. Slade. The two
lawyers argued the point. for five min-
utes before Mr. Slade finally appeal~
ed to the judge h the words.
”There are no myster on! things in
this country under our constitution.
There can be no mystery attached to
a man's address. I venture that
_Your Honor has never heard of such
a point or law either as a practicing
lawyer or as a judge.”
“No. I haven't," replied Judge
Howe, and he directed the witness to
answer the question.
The proceedings today were built
around the eirorts of the lawyers
representing the defendants to brealt
down the testimony of Grill. Records
of a commissioner's hearing in Phil-
adelphia were produced to show that
certain statements made by him to-
