One point usually overlooked in discussions of proposed changes
in the I'nited States Supreme ('ourt is that the number of judges
composing the court or the proportion required for a decision is not
fixed by the Constitution, and hasn't anything necessarily to do With ‘
the Constitution. _ )l
Originally there were six judges. The court naturally got into
the habit of deciding cases by a majority vote when the judges dis-
agreed; but a majority could not be less titan four to two. Thus,
in the early history of the court, there was never less titan a two-
thirds majority for any decision.
Obviously there is nothing essentially sacred about the present
practice of deciding cases by a bare majority of five to four, as the
court has done dozens of times since its membership was raised to
nine. And in fact, nothing has contributed more to invite criticism
of the Supreme (‘ourt and xvi-alien its moral authority than the re-
peated decision of cases by so slight a majority as one-half of a. judge.
This has been true particularly in cases where the court declared
unconstitutionala law passed by both houses of Congress and signed
by the President.
If the Bomb proposal to require a scvcn-to-nine vote in order to
invalidate a law of ('ongrcss is considered extreme, surely it is not
too much to require a two—thirds vote, such as the court itself was
accustomed to originally.

No Neglected Child
One outgrowth of the work of the American Relief Administra-
tion in saving millions of children from starvation in Europe and
Russia is the development of a plan to turn to the problems of
American child health the experience acquired abroad.
In a letter sent. out by the American Relief Administration, sign-
ed by Herbert Hoover, this statement occurs:
“Our physicians report that. over 80 per cent. of all children in
America are born normal, whereas less titan 20 per cent. reach ma-I
turity in normal physical health.” Here is Startling proof of neglect
and carelessness. In industrial centers, in backward sections of the
country and in most rural districts, there is great need of increased
effort to protect American children.
As a step toward using to better advantage the personnel, expe-
rience and executive efficiency of existing agencies, the American
Child Hygiene Association, the Child Health Organization of Amerio
co. and the. American Relief Administration have consolidated as the
American Child Health Association. Its fundamental belief is that
there should be. no child in America who “is not born under proper,
conditions, does not live in hygienic surroundings, ever suffers from;
malnutrition, does not have prompt. and efficient medical inspection
and attention. and does not receive primary instruction in the ele-
ments of hygiene and health.” , , , -
