United States Court‘ yesterday Judge
Edwin S. Thomas overruled, a. motion
i-y Lawyer Benjamin Slade to reduce
the bond of Joseph \V’eiesinan, in
trouble because of alleged conspiracy
to conceal assets in a bankruptcy
case, and continued it at 829.000. The
lrnvyer had made a motion to set the
bond at 810.000. and this wasstrenu-
ously combatted by Assistant D'trict
Attorney George H. Cohen. Bands in
the cases were continued at the pre-
vious figure. '
At a session May 8 Judge Thomas
had ruled that the indictment return-
ed against the accused was defective
: and without the introduction or evi-
dence had ordered the jury to return
a verdict of not guilty. to which Mr.
Cohen made strong objection. At
Tuesday's session counsel for all of
the sixteen defendants filed‘a special
plea in bar. claiming that the govern-
ment could not prosecute under a new
indictment. because they had already
been tried and acquitted under a for-
mer indictment charging. the some of-
fense. They attached a copy of the
former indictment to the special plea.
It is the contention of the govern-
ment that since Judge Thomas held
the first indictment to be defective.
the act-used were never in jeopardy
and that the men can be tried on the
new indictment which was released
