preme Conrt, yesterday accepted serv-
ice for Tax Commissioner Blodgett of
notice of the appeal to the highest
court which the executors of the Lena.
McMulien estate of Norwalk will take
to test the constitutionality of the
penalty clause of the state‘s inheri~
tance tax laws. The penalty tax on
the estate is a little more than $10,000.
As none of the lawyers in charge
of the state's case is a member of
the bar of the United States Supreme
Court and it was necessary to adapt
service 0 fthe notice of appeal immed-
iately Attorney-General Healy asked
Mr. Alcorn to make acceptance. Mir.
Alcorn said last night that his action
was a- mere formality necessary to al-
low the appeal to proceed.
