1018, provides that man: the powers
and duties or town school committees.

public schools. This power to employ
teachers. necessarily implies a power
to fix their compensation. The chart-
er specifically. in Section 169, pro-
vides that "The salaries of the super-
intendent of schools. and his assist.
ants, and the principals. teachers,
ianitors and secretary. appointed by
the Board of Education, shall be fixed
by said board.” Section 166 of the
charter also provides that the Board
of Education shall appoint a superin-
tendent of schools, and such number
of assistants, principals, teachers and
janitors as it may deem necessary,
and prescribe their respectice terms
of office and their duties.
The provision in the charter require
in: an appropriation to be passed on
by the Board of Estimate and Taxa-
tion. in my opinion gives said Board
of Estimate and Taxation (by power
to control all appropriations, the
amount of which is not otherwise fix-
ed by law: but where the provisions
of the law. as in the case of said
teachers' salaries, prescribe other
means of fixing the amount of appro-
priations; then the Board of Esti-
mate and Taxation is obliged lo ap-
propriate whatever is necessary to
meet the appropriations so fixed by
law. it will be observed that the
charter provisions giving the Board of
Education power to fix snairies of
school teachers. efc.. appears in the
charter subsequent to the provisions
relating to ihe Board Of Estimate and
Taxation, it is a general principal of
consiruciion that where parts of an
act are inconsistent. the later provi-
sion on the subiect will control the
former. In my opinion the intention
was lo specifically invest the Board of
Educaiion with power to fix teachers'
salaries and to_wilhdraw lhn power of
interfering with icacbcrs‘ salaries
from the Board of Estimate and Tax-
ation, ~

Board of Education is performing a
governmental duly, and acting as
spam of the State. and not of the city.
it has been held in the case of
Tumey vs. Bridgeport. 79. Connecti-
cut 229, that a rcstriclion limiting ex»
penditures by the city departments to
the uppI-Oprimions made. did not pre-
vent. the entering, by the Board of
Health, info a contract for a term of
years, although the aggregate sum
payable, under the contract, was
greater than the appropriation for the
year when the coniract was made,
3. The next quesfion is: What
would be the quickctst method of com-
pelling the Board of Estimate and
l‘axation to appropriate sufficient
funds to cover the teachers’ salaries,
as set by the Board of Education?
The law's delays are notorious and
I do not know whether there is any
quick method. One method would be
by writ of mandamus. providing the
Board of Estimate and Taxation can-
not be persuaded to do their duty
withoutvresort to litirsilon. As far
as the teachers. lhemselves, are con-
cerned. I believe that they could re-
cover their salaries from the city if
they go to work, under their appoint-
ment, with the salary fixed by the
Board of Education. _
