who gives his name as Caspar Strata,
but which name is believed to be an
alias. were arraigned before Judge Ne-
hemiah Candee in the uptown court
this morning for assault on aged David
Spicer.
Prosecutor Jesse nullity appeared,
for the state. and Judge J R. Taylor
and Attorney J. J. Cuneq'V for the ac-
cused.
Edward McGuirkV had h d
words with Mr. spice: at th tilne of
the assault and his temper got the
best of hith and his struck him, with
the result that he. wits 'placed under
arrest. Mr. Spicer. appeared at the
police station and.requested that no
bonds be fixed becaus‘é he was afraid
of McGuirk
. It is then alleged that the other men
assaulted him after this and he was
in a pretty bad way for a long time.
Mr. Spicer. who is in his Slst year.-
was on the stand up until press time
today and had told, his story. both on
direct e‘xaminatoln. cross- -examinntion
and re-direct examination. and could
not be tripped up in what he said. He‘
1 said that he could not positively iden-
tify the four men‘ who assaulted him ..
