H. L. Clark. of Norwalk, yesterday
court, civil side. to tell Judge How-
ard B. Scott and a jury his side of
the action for 82,000 damages which
he has instituted against Frederick
Bennett of Norwalk. The plaintiff
of the defendant in not lighting his
automobile lights and giving a prop-
per warning signal. he lost a vafhahle
horse and suffered severe personal in-
Juries.
The accident in question occurred
on August 2 1914, when Bennett’s
automobile struck a wagon which
Clark was driving. The latter told the
jury-that he was driving along the
thoroughfare at night. when he sud-
denly heard the noise of an automo-
bile engine.
The witness said that because at
the darkness and because the auto-
mobile hade no lights lighted he could
not. tell whether it was iipproaching
from the front or rear. Shortly after
he first heard the noise of the engine
the automobile 'truck the horse’s left
hind foot, infllc injuries which re.- ‘
sulted in its death.
Clark said that he was thrpwn off
the wagon and iruised. There were
two or three hers in the \ehicle
with him at tliertime. including his
brother. Frederick Clark.
