Solomon David of Danbury was
found guilty of murder in the second
degree on the first count by at Jury
in the Criminal Superior Court yester-
day. but the imposition of sentence
was deformed by Judge William. 8911- j
nett. as Charles F. Murphy, of coun-
sel for David. filed a motion to have
the verdict set aside on the ground
that it was contrary to the evidence.
David was charged with murdering
Joseph Ailey. formerly of South Nor-
walk. in Danbury last December. The
arguments upon Attorney Murphy's
motion will be heard by Judge Ben-
nett next Tuesday morning at 11 o'-
cock. ’ .,
There. were two count; against Da-
I'id. one charging him with killing
Ailey by shooting him in the chest
and the second charging him with
