John Phelan holds that the death of
Mrs. Rachel Simon, who was struck
and fatally injured by an automobile
driven by Timothy F‘. Foley of South
Norwalk on April 23.111113 accidental
and that Mr. Foley was not guilty of
any criminal act, omission or careless-
uses.
The accident happened on b‘alrtield
:avenue near Clinton 111 cnue. Bridge-
port on the morning of April 23 Mrs
Simon had stepped off a trolley car
and was standing in the street when
Mr. Foley’s machine approached. The.
driver blew his horn several times but
the deceased did not hear it. When
close to her. Mr. Foley shouted and
turned his car to the left so as to pass
behind the woman. Mrs, Simon, at the
same time, became aware of her don»
par and, turning sharply. run directly
in front of the machine, which was
then running at aspced estimated by
witnesses to be about it) miles an
hour. The deceased died in St. Vin»
cent'a Hospital a few hours later as a
result of her injuries. ..
Thursday afternoon the coroner
