Judge W. ll. Williams of the su-
perior court not yesterday as the date
of the hearing, and the forenoon was
occupied in listening to the arguments
as to whether Mr. Quinisrd's aplilli'll'
tion would be. dismissed or not. The
court. finally decided to open the ballot
box and have a recount. Attorneys
J. J. Walsh, d. Belden Hurlliutt and
A. 8. Perry, of Fairiield. were uppolnt~
ed counters, and they began their work
at 2 o'clock. Everybody supported
that the counters would get through
in an hour or two at the mosigbut at
5 o'clock Mr. llurlbutt came out and
informed that the count was not hail
over. Court was then adjourned and
the case will be resumed this after-
noon when the matters on the short
calendar are disposed of.

, According to the latest Inloruiution
from the counters Mr. Perry, of Fair-
Ileld, is throwing outvmore ballots its
irregular than were throwu out at the
election. In iiflbllng it should be re-
marked thnt there was a recount or
the ballots cast in the recent election
in Fairlieid, where Mr. Perry lives,
and the latter was present when Judge
Williams passed on a lot or ballots.
and threw out 11 per cent. of the total
vote cast, as stated at the time in The
Sentinel. The ruling or the court
then was very close. and all ballots
that were at all in doubt were thrown
out. So remembering .liuige Williams'
ruling Mr. Perry is throwing out bal-
lots that both Attorneys Walsh and
Hurlbutt would have counted. and the
discussions over the new throw outs
was the cause of the delay.
Returns May Change.
The chances are good that the re-
turns will be changed materially. for
it Judge Williams adheres to his tor-
mer ruiing he will undoubtedly throw
out more than did the Nor-walk mod-
erators. 01 course, only the votes or
Mr. Tooniey and Ilr. Quintard are at
