Judge Miller‘s address occupied
about an hour and he was immediate-
ly followed by Quincy Adams Gordon
for the prosecution. .
Gordon, denied Judge Millcr's state
ment as to the insufliclcncy of the evi-
dence and called attention to the tea-
timony of Boyle's mother that Helen
Boyle had said she expected to receive
some money soon. and the testimony
of the Cleveland policeman who said
Mrs. Boyle told him she was "the frail
little woman who planned the whole
thing.” Hones not so insistent in
asking for a conviction on the county
charging kidnapping as on the second
count, that of aiding, abetting and as-
sisting in It. He sold James Boyle was
not. smart enough to pllln the kidnap-
ping. but that his wife had done. it. and
admiited it. However. be said. “If
you are convinced that she did not
plan the kidnapping in Mercer county.
then It Is the, opinion of the common
wealth and we tell you now. she ought
not to be convicted."
At the conclusion of the address a
brief recess of court was taken.
Judge Williams charged the jury
with the courthouse doors locked, so
no one could enter or leave the room
during the charge. He gave practical.

“The jury cannot convict merely upon
theory. They must consider only the
sworn testimony of the witnesses. The
alleged conspiracy must be shown to
have been formed In Mercer County
and If the testimony does not show
this the defendant cannot “convicted
of the crime charged.”
The court said the. renting of the
rooms together in Cleveland and the
possession of the ransom money in
Cleveland does not constitute a crime
here. The court then gave the case
to the jury at “:40 o‘clock. and took
a recess until 1:30 p. 111.
