The supreme court yesterday hand-
ed down a decision in the famous Nor-
wnlk ...vision case, which... stripped of
the legal phraseology, declares that
Governor Chamberlain vetoed within
the legal time, tiio't‘esolutlon incorpor-
ating the town of South Norwaik and
that his veto, theretore, stands, and
no such town was Incorporated. While
the governor is allowed but three days,
Sundays exoepted, in which to submit
a veto, the court declares that he must
have three days during each of which
he has a chance to send the bill back
to the House in which It originated
.while that'l‘louse is In session. The
governor is not called upon to get out
a search warrant to find the House; it
must be (in bond;
The cases are of the State vs. ,South

, Norwaik. These two cases were ar-
gued together. each being information
by the state's attorney for Fairfield
county In the nature of a quo warrantlo;
One case was brought on the relation
of a citizen of the city of South Nor-
‘walk, The defendants were “the claim-
ed town of South Norwalk" and sundry
inhabitants of territory now or for-
merly part of the town of Norwalk.
The other case wds brought on the
relation of the town of Norwaik
against the ”pretended town of South
Norwalk," and alleged that it and In-
habitants of a certain part of Nor-
waik claimed to be a town by the
name of South Norwalk, and to have
all the privileges of a town lawfully
incorporated. On April 1, 1903, the
joint resolution incorporating the town
of South Norwalk was presented to the
governor, having passed both houses.
Thursday, April 2, the House adjourn-
to Tuesday, April ’I, and was in ses—
sion April 7 and 8. On the latter day
the governor returned the resolution to
the House, without his signature, and
the next day theflouse reconsidered
it. and it was subsequently put to vote

NEW YORK. Aug. lit—Tho north
bound Boston express of the New
York, New Haven & Hartford railroad
yesterday afternoon loosened the
blocking under a thirty-live ton truss
of the new driving bridge over the rail.
road tracks at. 204th street and Bronx
park, and the truss turned over, pre-
cipitating the other trusses of the same
weight and a twenty-ton girder to
which they were attached in the rail-
road cut. The last car of the express
was about 300 feet beyond the bridge
when the trusses fell, and the train had
a narrow escape. Five men were
working on the truss that turned over
and three of them felt. two of whom
were seriously injured. Frederick
Hartman, thirty- one years old, will pro
bnbly die.
The railroad cut at that place car-
ries four tracks, two of the New York,
New Haven and Hartford and two of
the Harlem River division of the New
York Central. On account of the den-
gerous work. two Iiagmen have been
stationed there since the work of build-
ing the bridge began. As soon as the
crush came one flagmau ran north and
the other south. The flagman who
went smith flagged the White Plains
express, going forty miles an hour.

to a stop about 100 yards below the

The accident resulted in a complete
tic- -up. and It is said that at least
twelve hours will be required to clear
