derwent an operation. Saturday, In the
Norwnik hospital. his right arm bolus
amputated near the shoulder. There
Is cheering news, however, in the an-
nouncemeut that Mr Foster came out
from the influence of the anaesthetic
finely and that there are strong hopes
for his recovery in spite of his advanc-
ed years and theiong Illness that has
weakened blis naturally strong consti-
tution. Mr Foster scratched his right
hand upon a nail projecting from a bar-
rel which he was handling about nine
months ago. The wound was compara-
tively slight. but blood poisoning ro-
sultod from it For several weeks Mr.
Foster‘ s condition was serious, but be
improved gradually and a for; weeks
ago it was decided that a stay at Bell
islands, of which be is one of the own-
ers. might be benllcial to him. He he-
came worse. however, after a short
stay at the Island and recently the
physicians who were attending him do-
cided that the only chance of saving
his life lay in the amputation of his
arm. Consequently he was removed
to the Norwslk hospital. where the
operation was performed as already
told, The operation was performed by
Doctor Walter llitchcoc assisted by
Doctors Huntington and Allen.

Suit Brought for injunction Against
Non- Union Hatters.
The United Matters of North Amer-
ica. the defendants in the important
action brought by 11E. Loewe &
Co., of Danbury to test the legality
of the boycott, have now gone to
law themselves and have even called.

The plaintiffs have brought, an ac-
tion against Charles H, Merritt &
Son of Danbury, one of the largest
concerns making hats in that city
which has always run an "open shop,"
to prevent the firm using a label.
it is alleged that the label used by
the firm is an infringement of the
one which is put out by the plaintiffs.
Through the secretary. Martin Law-
ier of Bethel. the courts are asked
to grant an injunction to restrain the
firm from using the label which it
has placed upon its hats for some
time.
The matter came up yesterday
morning at the county court house be-
fore Judge George w. Wheeler. The
plaintiffs” were represented by Attor-
ney Bristol at New Haven and At«
tomey Whittloscy of Danbury looked
after the interests of the defendants.
The first witness called was Martin
Lawler. He explained his duties as
secretary of the plaintiff association
and also told about the label. He
thought the label in the but which
was offered as‘au exhibit was an imi-
tation of the one issued by his asso-
ciatir‘m. lie was of the opinion that
it’ would deceive buyers. John H Mol-
fit of Philadelphia, president of the as-
sociation gave evidence of a similar
character.
George Gerry, a large manufacturer
from Newark. said that in his opinion
the label would tend to deceive. in
his opinion the mere fact that any in-
bel was sewed under the lining of the
hut in the same place would deceive
some buyers. '
Robert Clark, another large but
manufacturer from Newark, gave tos-
tlmony of a similar character. He
admitted upon cross examination that
it was practically Impossible to tell a
unidu made but from a nou- -union with-
out the labels.
