ney Caroll claimed that all of the pic.-
tures for which peyment is demanded
should be named or identified in the
statement a request which counsel for
Miss Rapier said it was impossible to

the pictures which she painted are. not
now to be found, and no record has
been kept of them. Then Attorney Car-
roll asked the court to direct that some
statement be'made bythe appellant in-
dicating whether she were charging for
her pictures by the picture. by the hour
or by the amount of canvas she cover-
ed with paint. “We want to know
whether she is charging for her pic-
tures by the square yard. the acre or
the tulle." said Attorney Carroll.

was argued took the papers and to
ward the end of June returned a ili‘tls-

amendment to the amended statement
of claim, stating whether Miss Kupft-r
expected pay for the work by the pic-

made by counsel for the appelnnt is
