about a year. When he returned Offi-
cer Adolhert M, Young met him on
the street. and knowing that a war‘

pleas court. Sullivan has instituted
suit against (illicer Young, claiming
damages of 32.000 for assault. The
allegation is that the officer had no
right to arrest him without a war-
rant. When the arrest was made the
warrant. was In the Ilunbnry police ata-
tlon. This claim is met by one that
the officer had a legal right. to make
the arrest when he know that a war-
t'ant was out for Sullivan. and it was
not necessary for him to have the war—
