NOT FOR A TRADEMARK.
Patent Commissioner’s Decision With
Respect to the Word Yale.

The refusal of Acting Patent Corn-
missioner Moore to register the word
“Yale" as a trademark for Posts bolt
supporters has just been announccd.
and is of considerable interest. capac-
Iully In Stamford. where the name Is
associatcd with a big manufacturing
concern and one of its principal pro-
ducts. ln his decision Commissioner
Moore says:

"The Word ‘Yaic' is: not an arbitrary
word. it is true that to many people it
would signify the great university at
New llavcn. Conn, named in honor
of the historic personnce. Elihu Yalc.
The word ‘Yalc,’ has, however. a goo-
graphical signilcunco. and is also 11
mars or less common surname. Each
of these facts has been shown to be
true by the examiner. It id clean-thou.
that the word ‘Yalo' is not such an
arbitrary word as would make if the
sole property of any one individual.
"The word ‘Ynlo' corresponds in all
rcspccts with the word Bowdoin.
wluclr was rci'uscd registration as II
trademark for coffee by Commission-
cr Ducli in exports Shaw, Hammond
8: (Im'ncy.

“The petition organs that almost an
ivcrsally to speak of an article as ~41
l’ulc lock. ll Yale radiator. or a Yalc
icrnc plutc. would ho to indicate that
tho articlc had something to do with
car-cfully Inadc mccbunism.

‘This argument that the word ‘Yalc'
has a spacial significance in that the
articles to which it refers are carotid
ly mndo pieces or mechanism 804.9 forth
another ground for refusing registra-
tion—that of its having a descriptive
significance."

The commissioncr then confirms the
decision of the cxumincr from which
Mr. Pcats appealed through his attor-
ney. C. R Edwards. Accordingly Mr.
Feats will have to find some other
namo that that of the university to
designate his brand of hell supporters.
