An act in rcla'thn to the duties of school
visitors.
Be it enacted by the Senate and House of Repre-
sentatives inuenoral Assembly convened:
Sec. 1. It shall he the duty of the chairman
; of the board of school visitors in every
town to calla meeting of the board at least
once every six months, and oftener if he
. ', ~shall deem it necessary. In case ofthe ab-
‘ - tonnes of the-chairman, or ofhis‘inability to
act, the secretary of the board shall, in like
manner, call a meeting of the board.
. ISec‘. 2.-The chairman, or in his absence
or inability to act, the secretary of the
board of school visitors, shall calla meeting
of the board whenever requested, in writing,
so to do, by three or more members of the
board-
Sec. 3. Whenever the chairman or secre-
tary of a board of school visitors shall neg-
lect or refuse to call a meeting of the board
for the period of fourteen days after having
."bcen requested, in writing, so to do, by
three or more members of the board, any
three members of the board may, thereupon,
oil] a meetin'r of all the members by glVlng
the usual notice in writing, and the meeting
held in pursuance of such call, shall in all
respects, be as valid as if it had been called
by the chairman or secretary of the board.

Sec. 1. Whenever any person shall have
become an habitual drunkard, a dipsomaur
ac, or so far addicted to the iutcmpcratc use
of narcotics or stimulants as to have lost
the power of self-control, the court of pro-
bate for the. district in which such person

lager beer, unless he shall have previously

hereinafter provided.
Sec. 2, Any county commissioner or other

, by this act, or the act to which this is in ad-

Sec. 4. The board of county commissron:
ers of each county in this state may_ grant
licenses under the provisions of this act,
and of the act to which this is an.a(lditi_on,_
for the sale ofale, lager beer, Rhine mac,
and cider, only, upon the payment of the
sum of fifty dollars.
Sec. 5. If any person licensed to sell ale,
lacerbeer, Rhine wines,- and; cider, only,
shim keep, sell or give away in the particu-
lar building or place where such person is
so licensed to , ale, lager beer, Rhine
wines, and old
toxicating liquors, such persons shall for
such offense, be subject to all the penalties
provided by law for unlicensed persons,
and may he proceeded against, prosecuted,
and punished as such.
Sec. 6. Licenses granted under this act
shall be transferable by consent of the
county commissioners upon the fulfillment
by the transfer of similar conditions to those
required from the original license.
Sec. 7. WheneVer any licpnscd shall de-
sire to remove his place of business from
one building in the town to another in the
same town, the county commissioners, upon
the recommendation of the selectmcn .of
such town, shall have power to grant him
permission so to do, if they deem it expedi-
ent; and in allsuch cases shall endors such
permission in writing on said license, which
said license shall be effective thereafter, to
protect said license in the premises to which
he shall have so removed.
'Sec. 8. The county commissioners of
each county shall appoint One or more per-
sons residiug in such county, as they may:
deem expedient, to be designated prosecu-
ting agents, whose duty it shall be diligent-
lv to inquire into all violations of the laws
relating to the sale ofspirituous or intoxicat-
ing liquors, ale or lager g beer therein, and
who shall 11' vc and exercise in any town
in said coun y, the powers of grand jurors
of said town or prosecuting officers of any
city, in prosecution for such violations, and
shall prosecute therefor; and in such
prosecution, tried in the superior court, such
agents shall render such aid, and give such
information as the state attorney may re-
quire, and shall also render monthly reports
of their doings to the county commisstoncrs
of said county; and for non-performance of
duty, or other cause, shall be forthwith re-
moved by suid commissioners, and others
appointed in their stead.
Sec. 9. Every prosecuting agent appoint-
ed under the provisions of the preceding
section, shall be paid ten dollars for each-
case commenced and prosecuted by him to
final conviction, bef’: a justice of the
peace, city or police court, or before any
superior court in any county in this state;
which said sums shall be in lieu of all other
fees and allowance to said agent; and the
selectuien of the town in which the ofl'r-nce
is committed, for which the prosecution
shall be brought, shall draw their order on
the treasurer of such town, in favor of such
agent, upon the certificate of such justice of
the peace or clerk of the court, stating the
name and title of the case,and the person who
acted as agent in the prosecution thereof.
Sec. 10. The payments authorized to be
made under the next preceding section shall
be taxed by such justice cf the peace or
city or police court, in the bill of costs
against the accused, if they be found guilty;
and, when collected, shall be paid by said
justice or clerk of such city or police court
into the treasury of the town which shall
have been required to pay the same to such
prosecuting agent.
Se c..11. Nothing in this act shall be con-
strued to prevent the taking of license at
any time during the year, under the provis-
ions hereof with a proportionate deduction
front the amount of the annual license fee,
according to time; nor shall it affect any
license already issued, which does not ex-
pire until after the 3lst day of October, A.

See. 12. No person so as aforesaid licens-
ed to sell any spirituous and intoxicating
liquors, ale or lager beer, shall sell, ex-
change or give to any minor, or to any in-
toxicated person, or to any habitual drunk-
ard’, or to any father, mother, husband,
wife or child, whose child, wife, husband.
or parent respectively have, in the manner
hereafter provided, notified him not to do
so, any spirituous or intoxicating liquor, ale
or lager beer, flier shall any such person
sell,exchange or give to anyone, any im-
pure, spurious, or adulteratcd liquors, ule or
lager beer.
Sec. 13. Whenever any person shall com-
plain to any of the selectmen of any town,
that his or her father, mother," husband,
wife, or child are addicted to the use of
spirituous and intoxicating liquors, ale or
lager beer, and shall request said selectmen,
_in writing, to notify the licensed dealers in
saidtown not to sell, exchange or give to
said father. mother, husband, wife or child
any spirituous and intoxicating liquors, tile
or lager beer, such selectmen shall forthwith
notify, in writing,cvcry licensed dealer in
said town, that such request has been made,
and that the sale, exchange or gift of spiri-
tuous and intoxicating'liquors, air, or lager
beer to such father, husband, wife or child
is absolutely prohibited by law.
See. 14. Any person or persons who shall
procure or furnish any spirituous or intoxi-
cating liquors, alc'or lager beer to any per-
sonor persons who have been refused the
same in accordance with section 12 of this
act, shall be deemed guilty of a misdemean-
or, and on conviction thereof, shall be pun-
ished by a line of not less than twenty dol-
lars, nor more than fifty dollars, or by im-
prisoninent in the county jail not exceeding
sixty days, or by such fine and imprison-
ment both.
Sec. 15. No person licensed under the
prececdiug provisions of this act to sell any
spirituous or intoxicating liquors, ale or
lager beer, shall,betwecn the hours of 12
o‘clock at night and 5 o’clock on the follow-
ing morning, keep open any place, apart-
ment, store or room where such spirituous
or intoxicating liquors are sold or exchang-
ed, or are kept or exposed for sale or ex-
changc,nnder a penalty of not less than
seven dollars, nor more than fifteen dollars
for each and every violation.
Sec. 16. Prosecutions for the violation of
this act, and of the act to which this is in
addition, shall be heard‘and-determiued by
a justice of the peace or city or police
court in cities where such court exists, sub-
ject to the right of the accused to appeal
from tliejudgment of such justice or couit,
as in other criminal cases.
See. 17. The, bond to be taken on the
issuing of each license for the sale of ale,
lager bccr, Rhine wines and cider only,
may be in the form prescribed in section 9,
of the act to which this is in addition, omit-
ting the words “spirituous and intoxicating
liquors” therefrom.
Sec. 18. All acts and parts ofaets inconsis-
tent herewith, are hereby repealed.

Be it enacted by the Senate and House of Repre-
sentativesm General Assembly convened:

commissioners” be, and is hereby repealed,
and all ofiices created by said not be and are
hereby abolished.

An act relating to unsafe buildings.
Be it enacted by the Senate and House of Repre-
sentatives in General Assembly convened:
Sec. 1. The Selectmen of the several
towns shall have power to make written or-
ders and requirements in any case relative
to the erection, censtruction, maintainanee
or repair of any building within their re-
spective towns with reference to public and
private safety, after reasonable notice to
the owner, builder or occupant theifitt’, and
upon such examination may make such or-
der for the removal, repair or protection of
. such building as they may deem expedient,
and cause the same to be served upon the
owner, builder or occupant by some proper
ofilcer,’leaving with or at the usual place of
abode of such owner, builder or occupant a
true and attested copy of said order. '
Sec. 2. Such owner, builder or occupant,
if aggrieved by such Order, may within
three days after service thereof, apply to the
superior court or to thejudge thereof in va-
cation lor the appointment of three disinter-
ested freeholdets, inhabitants of some other
town or towns in the. same county, to re.
view the doings of said selectmen, Which
freeholdcrs shall be appointed by such court
orjudge after due notice to such appplicant
to be present and be heard relative to such
appointment, and said free-holders shall
thereupon proceed to a rc-cxaniinatiou of
the promises, and shall report their determi-
nation to the superior court for acceptance,
and the same being accepted it shall take I
effect the same as an original order, and the l
court may award costs in its discretion as :

Sec. 3. The sclectmcn, in cast-s of‘tlie neg-
lect or rcl'uSal' of an owner, builder or occu-
pant of any building to conform to an order
made as aforesaid, unappealed from or final
after an appeal, for its removal repair or
protection, for a‘ period of ten days after
the making of such order, may cause such
order to be executed, and the costs of its
execution may be rccove 'ed against such
owner, builder or occupan in an action in
favor of such town under this statute; and
such owner, builder or occupant shall also
be liable to a penalty of not exceeding one
thousand dollars, to be paid one'half to the
treasurer of the town and one half to the
person who shall prosecute for the same.

An act for the more effectual prevention of
cruelty to animals.
Be it enacted by the Senate and House of Repre-
sentatives in General Assembly convened :
Sec. 1. Whoever overdrivcs, drives when
overloaded, overworks, tortures, deprives of
necessary ”sustenance, cruelly beats, muti-
lates or cruelly kill,,any animal, or cause
- be same to bedone, and whoever having
a charge or custody.of any‘animals either
as owner or otherwise, inflicts unnecessary
cruelty upon the same, or unnecessarily
fails tc provide the same with proper food;
drink or protection from the weather, shall ‘
for every such offence, be punished by int:
prisonmeut in jail not exceeding one year
or byrfine not exceedingtwo hundred an
fifty dollars, or by both such fine and im-
prisonment. -
Sec. 2. Every person having the care of
any animal, ‘who cruelly abandons the same,
or who carries the same or causes the same
to be carried in or upon any vehicle, or oth-.
erwise, in an unnecessarily cruel manner, or
knowingly and wilfully authorizes the same
to be done, shall be punished for every such
offence in the mannner provided in section
one.

ing, for a period of at least five consecutive

which they are received shall be included,
animals so unloadejshall be properly fed,
watered and sheltered during such rest by
the owner or person having the custody

the‘same, at the expense. ,_ aid owner or
person in custody thereof ;"and said cOmpa-
uy shall, in such case, have a lien upon such.
animals for food, care and custody furnished
and shall not be liable for any detention of
such animals authorized by. this act; any
company, ojvner or custodian of such ani-
mals who shall fall to comply with the pro-
visions of this section, shall for each and
every such offence be liable for and forfeit
and pay penalty of not less than one nor
mqre than five hundred dollars; provided,
however, that when anintals shall be com-
ed iu cars in which they can and do have
proper food, water, space, and opportunity
for rest, the foregoing provision in regard to
their being unloaded shall not apply. ,
Sec. 4. Any person found violating the
laws in relating to cruelty to animals, may,
be arrested and held with warrant in the
same manner as in case of persons found
breaking the peace; and the person making
an arrest shall use reasonable diligence to
give notice thereof to the owner of animals
found in the charge or custody of the per-
son arrested; and shall properly care and
provide for such animals until the owner
thereof shall take charge of the same; pro-
vided,tlie owner shall take charge of the
same within sixty days from the date of
said notice; and the person making such ar-
rest shall haOe a lien on said animals for the
expense of such care and protection.
See. 5. When complaint is made on oath
or affirmation to any magistrate authorized
to issue warrants in criminal cases, that the
complainant believes and has reasonable
cause to believe that the laws in relation to
cruelty to animals have been or are being
violated in any particular building 0r place,
such magistrate, ifsatisfied that there is rea-
sonable cause for such belief, shall issue a
search-warrant authorizing any sheriff, con-
stable, or police officer, to search such build.
ing or place, but no such search shall be
made after sunset, unless specially authori-
zed by thc magistrate upon- satisfactory
cause shown.
Sec. 6. In this act the word “animal" or
“animals" shall be held to include all brute
creatures and birds. The knowledge and
acts of agents of and persons employed by
corporations in regard to animals transport-
ed, Owned or employed by or in the custody
of such corporations, shall be held to he the
acts and knowledge 01' such corporations.
Sec. 7. It shall be the duty ofall informing
ofilccrs to prosecute all violations of. the
provisions of this act which shall come to
their notice or knowledge; and fines and
forfeitures collected upon or resulting from
the complaint or information of any officer
or agent of any society for the prevention of
cruelty to animals shall inure and be paid
over to said society. ' '

Sec. 1. Any person aggrieved by any or-
der of the railroad commissioners hereafter
made upon any proceeding relative to the
locatiou,abandonmen't or changing of de-
pots or stations, to which he was'or ought
to have been made a party, may appeal
from the same to the superior court of the
county in which the cause of appeal shall
arise, within twenty days; :afte‘i- the publica-
