To the Honorable, General Assembly-
To beholden at Hartford, on the first Wednes-
day of May, A. D. 1871.
The petition of the Borough of Norwalk,
in the County of Fairfield, respectfully
showeth r—That an act incorporating the
present Borough of'Norwalk,was passed by
the General Assembl , in 1869, and that the
public interests of sard Borough and pubhc
convenience and necessity require certain
amendments of the charter of said Borough ;
that at a meeting of said Borough, legall
warned and held on the 14th day of Apri ,
A. D. 1871, it was noted to petition your hon-
orable body to amend the act incorporating
the Borough as follows:— .
SEC. 3. After the word burgesses, strrke
out “ a clerk."
SEC. 4 1n Ilw. fitlh litre, afterlhe word
“ than,” strike out the word “ten’.’ and in-
sert “twenty.”
SEC. 17. First line, after the word “Bor-
oag ,” insert “shall be appointed by the
Court of Burgesses, he." .
SEO. 23. Seventh page, twelfth line, insert
the words, “billiard, bowling and liquor
saloons ;" in the 18m litre, strike out. all
. after the word “Borough” to the word “the”
in the 19th litre.
SEC. 26. Strike out the first sentence and
insert: The Court of Burgesses shall have
power and authority to establish, by ordi-
Dance, a district or districts in said Borough,
within which no person shall erect, enlarge
or elevate any building or addition to a
building, unless the outer walls and roof
thereof be composed whollljy of fire-proof
materials, as the Court of urgesses shall
prescribe; and no person shall move anv
building from one place to another in said
district, or frotrr within said district outside
the same, unless the exterior walls and roof
of such building be composed wholly of
fire-proof materials; provided, however,
that buildings of not greater dimensions
than twelve feet square and one story high,
not having t‘1e outer walls and roof thereof
composed of fire-proof materials, maybe so
erected or moved, subject to the restriction
that there shall never, at any time, be any
,chimncy, fire-place, stove, furnace or stove-
pipe in or attached to such building; pro-
provided, ‘further, that said Court of Bur-
gesses may by a major vote of all the metn-
bers thereof, remove'the prohibition herein
imposed, as to any particular building, upon
the written petition to said Court therefor,
of all the owners of property adjacent to
the lot on which such prohibited building
may stand or be proposed to be located,and
not otherwise. .
In section 20, wherever the word “may”
occurs, strike out and insert “shall.” .
Strike out Sections 34, 35, 36 and 37, and
substitute the following:
SEC. 34. Beforethe Court of Burgesses
shall determine to lay out, alter, extend, en-
large, discontinue or exchange any high-
way, street, public‘ walk, public avenue or
public landing place in said Borough, or to
desrgnate any line between which and the
highway it shall not be lawful to build, they
shall cause a notice signed by the Warden
of said Borough or the Clerk of said Court,
describing in general terms such proposed
lay out, alteration or line, and specifying a
time and place when and where all persons
whose land is proposed to be taken therefor
may appear and be heard by said Court of
Burgesses in relation thereto, to be publish-
ed not less than twice in a pa er published
in the borough, at least three (‘ ) days before
the time fixed in said notice for such hear-
ing, and such publicatiOn of said notice
shall be legal and sufficient notice to all
persons and corporations whose land is
proposed to be taken by such lay out, altera-
tion or line. At the time and place men-
tioned in said notice, and at any meeting
adjourned therefrom, said Court of Bur-
gesses shall bear all the parties in interest
who may appear and desire to be heard in
. relation thereto.
SEC. 35. If, after said hearing, said Court
of Burgesses shall resolve to lay out, :tltcr,
extend, enlarge, discontinueor exchange
such street, highwaynvalk, avenue, landing
place, or designate such line, the shall ap—
point a committee, whose duty I shall be
to make such layout, alteration, or desig-
nate such line, and report in writing their
doings to said Court of Burgesses, which
report shall embody a survey and particular
description of such street, highway, walk,
avenue, landing place, alteration thereof, or
line. If said report shall be accepted and
’ approved by said Court of Burgesses, the
Warden, or in his absence or inability to
act, the Senior Burgess present in said Bor-
ough shall appoint three judicious and dis-
interested frccholdcrs of said Borough to
estimate and appraise the damages or bene-
fits, as the case may be, resulting or accru-
ing to an person or persons from the taking
of such and for public use, as aforesaid, or
from such lay out, alteration or extension;
enlargement, discontinpance, exchange, or
the designation oi such line. Said frec-
holders shall be sworn to a faithful and itn-
partial discharge of the duties of said ap-
pointment, by the oflicer appointing theut,
and a certificate of such appointment and
the administration of such oath shallbc
made, under the hand of the officer appoint-
ing them, and recorded in the records of
said Borough. Beforemaking any such
assessments of damages and benefits, said
freeholders shall give reasonable notice to
all persons interested, of the time and place
when and where they will meet for that
purpose. Such nOIice shall be deemed
reasonable if signed by the said freeholders,
or a majority of them, and published in the
same manner as provided to be done by the
Court of Burgesses in section 34 of this act,
or if given in such other manner as the
Court of Burgesses by ordinance may pre-
scribe. Said freeholders shall meet at the
time and place designated in their said no-
tice, and at such other times and places as
they may adjourn to therefrom, and shall
bear all the parties in interest who may ap-
pear before them; and shall thereupon
ascertain and determine what person or
persons will be damaged by such taking of
said land, or by such lay out or alteration,
and the amount thereof over and above any
special benefits such person or persons may
receive therefrom; also what other person
or persons may be specially benefitted by
such taking of sail land, or t-y such lay out
or alteration, and the amount thereof over
and above any damages such person or per-
sons may receive therefrom; also what
other person or persons will receivfi an
equal amount of damages and benefits
thereby, and such freeholders shall report
the atuonnts of damages and benefits thus
ascertained and determined, and the_names
of the persons to whom the same respective-
ly appertain and-belong, to the Court of
Burgesses, who may accept said report or
return the same to said freeholders for re-
consideration and correction; and upon
the acceptance of said report, the Clerk of
the Borough shall record the same in the
' Borough records,.provided that the whole
amount of benefits assessed, for any par-‘
ticular lay out, alteration, or the designa—
tion of such line, shall not exceed the whole
amount of damages assessed on account of
the same lay out, alteration or line. Said
Court of Burgesses shall cause a notice
signed b the Warden .or Clerk of said
Court of urgcsses,'containing the names
of the persons thus assessed, with the
amounts of their respective assessments, to
be published not less than twice in a news-
paper published iu the Borough ; and such
publication shall be deemed to be legal and
sufficient notice to all persons interested in
such assessments, and the same shall there-
upon'immediatcl become due and payable.
The Court of urgesses shall order the
damages thus assessed and determined to be
paid to the persons to whom they respective-
ly belong out of the treasury of the Bor-
ough; provided that if any person shall re-
fuse or neglect to receive the amount so
found due and ordered to be paid to him,’
the same shall be deposited to the Borough
treasury, to be paid to the person entitled
to receive it whenever he shall apply for
the same. The assessments oflbeneiits so
made'sball be and remain ‘a lien or real in-
cumbrance upon the land upon which they
are respectively made, and shall take pre-
cedence of all subsequent liens or incum-
bruuces thereon, (except taxes due the
State), and the lands, with the buildings
thereon, on which any such lien may exist,
shall be liable to be foreclosed in the same
manner 'as if said lien were amortga e ‘on
said lands and buildings, in favor 0 said
Borough, to secure the amount of such as-
sessment ; provided, however, that such lien
shall not continue to exist for a period
longer than sixty days after the publication
of the notice thereof, as aforesaid, unless
within that period a certificate signed by
the Warden of said Borough or Clerk of
said Court (describing the premises on
which snob lien exists, and. the amount
claimed by said Borough as a lien tlrereon,)
shall be lodged with the Town Clerk of the
Town of Nerwalk; and provided, further,
that such lien shall cease to exist whenever
a certificate to that efi‘eet, signed by the
Warden or Clerk of the Court of Bur esses
for the time being, shall be lodged wit said
Town Clerk. All such certificates said.
Town Clerk shall record with deeds of
lands; and said assessments may also be
collected bywarrant, under the‘hnnd of the
Warden of said Borough, in the same man-
ner as town taxes are by law collected. .
SEC. 36. Upon the acceptance of , the re-
port Oi said.freeholders,the survey and par-
ticular description herein before required to
be’made, shall be signed by the Warden, or
in his absence, by the Senior Burgess pres-
ent in said Borough, and recorded in the
records of said Court of Bur esses, and said
Court of Burgesses shall imtt the time
within which such street, highway, public
walk, public avenue or pubhc landing
place shall be Opehed,or such lines desig-
nated; and may give such notice of said
limitation as they shall deem expedient, and
at the expiration of the timeso.litii_ited,may
adopt any and all such measures, and make
and cause to be executed all such orders as
shall be necessary and proper to appropri-
ate the same to the purposes for which the
same was laid out; providcdthat no such
street, highway, walk, avenue or landing
place shall be opened, or lines designated,
until the damages assessed shall be paid or
deplosited in the Borough treasury as afore-
sar . ,
SEC. 37. The Court of Burgesses of said
Borough shall have power and authority to
construct or cause to be constructed any
sewer or sewers, with wells» or catch basins
connected therewith, along any. Street or
streets, or public grounds, and to purchase
for said Borough any such sewer already
constructed and not owned by said Bor-
Ollgh. and to assess not less than one half of_
the cost of any sewer so constructed or pur-
chpScd upon the property benefitted or 1m-
proved thereby, in proportion to such bene-
fits, and also to appraise and apportion any
and all damages which may accrue from
,the construction of any such sewer. Before
proceeding to construct or purchase any
such sewer, the Court of Burgesses 'mey
give such‘notiee as they shall deem expedi-
ent of such proposed construction or pur-
chase, and of a time and place when and
where the parties interested therein maybe
heard by said Court of Burgesses in rela-
tion thereto. And in all proceedings con-
cerning the construction or purchase of
sewers and assessments of costs, damages
and benefits, said Court of Burgesses may
act by themselves or by a committee of
them appointed for that purpose. After the
construction or purchase of a'oy spch sewer,
and the apportionment cfat least one half of
the cost thereof among the holders of
property benefitted or improved by such
sewer, said Court of Burgesses shall give
notice to said property-holders of the sev-
eral sums so assessed upon them respective-‘
ly, and of the time when the same shall be—
come due, and thereupon at the time so
specified shall assessments be deemed to be
completed, and said sums shall be due and,
payable; and the same shall be and remain
a lien or real Incumbrance upon the proper-
ty upon which they are respectively assess-
ed, in favor of said Borough; and the ay-
ment thereof may be enforced by said or-
ough in like manner in all respects as is
authorized and provided in section 35 of
thisfict in the case of assessments of bene-
fits for the lay out or alteration of highways
and streets ;- and all the provisions of said
Section in relation to liens and the'collec—
tion of benefits are incorporated into and
made part of this Section. .
. Section 38, to be altered in the fifth line
to 30 days instead of 60.
. ADDITIONAL SECTIONS:
Any member of the Court of Burgesses
who shall, while holding office therein, di-
rectly or indirectly take or bargain for any
fee, compensation or reward to influence
his official vote or action upon any resolu-
tion or By-Law pending in said Court of
Burgesses, shall pa the said Borough a fine .
of Five Hundred Dollars andbe expelled
from said body, and be forever disqualified
from holding any oflice‘ therein.
It shall be the duty'of the Court of Bur-
gesses to publish, on or before the third
Tuesday of November in each year, in at
least one newspaper in said Borough, a full
and detailed statement of all the receipts
and disbursements ot the Borough during
the precedingmunicipal year; in which
said statement the different sources of the
revenue of said Borough, the amount re-
ceived from each, the several appropriations
made by the Court of Burgesses, the objects
for which the some were made, the amount
expended on each, the monies borrowedton
the credit of the Borough, the authority on
which the loans were made, and the full
atnount of all the debts and liabilities of
the Borough, shall be fully and particularly
described, and said statement shall be re-
corded in full in the records of said Court
of Burgesses.
All proceedings instituted by the Court
of Burgesses of said Borough for the lay out,
alteration or enlargement of any highway,
street, public walk or public avenue, or for
laying out or building any sewer, or for
making any other public improvement in
said Borough, or for any other purpose, and
not completed when this act takes effect,
shall thenceforward be prosecuted, and the
rights and duties of the parties in interest
shall be regulated and determined under
and according to the provisions of this act,
provided that nothing in this, act contained
shall be construed in any manner to release
or affect; any taxes, or any assessments of
benefits or damages heretofore laid, any
debts or liabilities due to or from said Bor-
ough, or any fines. forfeitures or penalties
heretofore incurred; but the saute may be
collected, enforced or paid in the same man-
ner and to the same extent as if these
amendments had not been passed; and pro-

contained shall operate to repeal any By-
Law, ordinance or order of said Borough
now in force, but every such By-Law, ordi-
nance and order shall continue in force until
repealed; and provided, further, that noth-
ing herein contained shall efi‘ect any suit or
appeal now pending. .
' And your petitioners would further pray
that an not entitled “An act to provide a
supply of pure and wholesome water to the
Borough of Norwalk,” passed at the session
of the General Assembly in 1870, ”may be so ,
amended that section 5th of the some will
read as follows: ' _ . .
“For thepurposé of defraying the cost of
construction of said water works, and ex-
penses incident thereto, and 'for no other
purpose whatever, said Borough is hereby
authorized and empowered to issue notes,
bonds or certificates of debt, to be'denomi-
nated on the face thereof, “Water Fund‘ of
the Boroughof Norwalk,” toanamount
not exceeding in the whole'the sum of one
hundred and seventy-five thousand dollars,
bearing interest at no greater rate than seven
per cept. per annum, the principal of which
shall be ‘payable at some certain time or
times within thirty years alter the date of
isale, and the amount of said notes, bonds
or certificates which may at an time be
issued, together with the times 0 pa ment
of the principal and interest thereo ; and
the rate of interest shall be prescribed by
said Borough, in legal Borough meeting
called for that purpose, and said notes,bonds
and certificates shall be signed by the-
W ardcn and countersigned by the Clerk of
her and amount of each. bond issued on the
records of said Borough. And said bonds
and certificates shall, when issued, be obli-
ants thereof, according to the purport and
tenor of the same. I ' ' ’ '
The said Borough, therefore, 'praysyour
honorable body to grant said amendments
to said Charter, and also otherwise to amend
the same, or in some Other way to grant re-
lief, and your petitioner's, as in duty bound,
will ever pray. '
