shall perforin military duty in complete
uniform in pnrsiialicc of the provisions of
this act, the sum of lwo dollars, for each
and every day of such .duLy. To each
member of rcgiineiital band, dilly organ-
ized and fully equipped in the prescrib-
ed uniform, and who shall perform duty
at any rcgiiriciilal 01' brigade review,
two dollars and fifty cents for each day
of sucii duty; and one ilollar and fifty
cents shall be allmveil for each horse
used on~any parade required by this act.
SEC. 50. .l'Ivery company that shall
conform to the provisions of this act shall
be allowed out of the treasury of the
Slate, the sum of one Iiniillrcil dollars

iment to which such company belongs,
and shall leave a copy thereof with the
Treasurer of the Town in which a ni:ijor-
ify of sale persons reside.
Size. 56. The coiumauding officer of
each regiment shall annually within twell
fy days after said parades, make out, cer-
tify under oath, and retilm to the adju-
tanf. general, a complete list of all per-
sons reported by the coinniandants of the
respective companies under his command
together with the members of his regi-
mental band, who are entitled to be paid
for military services as aforesaid, stating
the sum due to each, and the town in
which they respectively reside; and the
adjiuant general shall on or before the
first day of November annually forward
the same to the comptroller, who shall
draw all order on the Treasurer, direct-
ing him to pay the Treasurer of the sev-
eral towns, where a majority of llielncin-
bers of the several companies reside, the
amount due said members respectively ;
and the Treasurers of said towns shall
day on and after the fifteenth day of No-
vember, annually, the sums dlic mem-
bers of companies whose names have
been returned to them as herein before
provided; and the said town Treasurers
shall be entitled to two per cent. on all
moneys disbursed by them in pursuance
of this section, to be paid by their seve-
ral towns.
SEC. -57. The coniillanllallts of regi-
ments, brigades and of the division, shall
aiinually, on or before the first day of
November, make out and rcturil under
oath to the cornptrollcr a list to ihe-mein-
hers of their respective staff who are eli-
iled to coilipciisatioii as provided in this
act, with the number of days duly per-
fornicd by each: and the comptroller
shall thereupon draw an order upon the
'.l‘icasurer directing him to pay, UN and
after the gflecnth day of November in
each year, the suiil due to each of the
pl-rsuiis respectively named in such list.-
Si-zc. 58. Any officer who shall neg.

form the duties required in the three

penalty no; exceeding iliree hundred dol-
lars, to be recovered in an action of debt
in the name of the State, and to be paid

CHAPTER. VII.
0/" Fines.
$156. 59. Every commissioned officer
whether of the field or company, for any
neglect of duty, 01' for disobedience. ofor-
ders, or for amt unofllcer like conduct,
shall be liable to be tried by a courlmar-
rial ; and every non commissioned officer
musician and private, of any company or
band, who shall, without satisfactory ex-
cuse to the coniinziliding officer, fail to
appear at the time and place appointed
for any parade or choice of officers, or
who, after appearing shall leave said pa-
rade or meeting for the choice of officers
without the permission of the comman-
ding officer, shall forfeit his annual pay
for that day’s services, and shall also pay
21 fiile of two dollars for each day or time
of absence or ncglectof duty; and every
non commissioned officer, musician and
private, who shall be guilty of ally lili-
soldierly or disgraceful conduct, or diso-
bedience of orders, may be fined by his
coininailding officer to an amount not ex-
cceding five dollars for eaclioffensc; and
all persons who may have in urrcd any
fine or forfeiture shall be notified of the
salnc within five days lliereafter.
Size. 60. The certificate of any coin-
iiiaiidiiig officer, made under oath, shall
be evidence of any and all forfciturcsaiid
gncs iilclirreil in pursuance of this act;
and if ally forfeitlire or fine iiicurred as
aforesaid shall not be paid within ten
days after notice thereof, the said coni-
manding officer may collect the tame in
an action of debt in his own proper name
and shall have process of atfaclinient
and execution against the body of the
dclinvucnt, to he proceeded with in all
respects as in aciinus of fort; and all
lilies and forfeiturcs iiicuired niider this
act, when recovered shall be appropria-
tell for the benefit of the colnpany or
band to which the delinquent belongs,
to be used in the purcliasc of uniforms,
music and musical instruments, and any
other articles necessary in the pcl‘f0l'lll-
once of military duty; and the coininan-
ding officer of every company and build
shall keep or cause to he kept ii. correct
account of all inoney thus received, and

such fines shall be collected and appro-
priated in the saline manner as provided
in the prccedingsection.
Size. 62. No member of any military
company or band shall be released or ex-
cused from the performance of military

officer of such military company or band
CHAPTER VIII.
On, yiroccecliug in case (J alarm-
Si-zc. 63 The commander in chief, or,
in his absence, the major general, may
on an alarm, invasion, or notice of the
appearance of an enemy, either by sea
or land, order the whole, or any part of
the militia to assemble, and may lead, or-
der, or employ them, for the assistance or
relief of ally of Lhcinhabitants of the state
attacked by an enemy, or in danger of
being attacked, and may issue and pub-
fish such orders as he shall judge expe-
dient to carry into execution the interests
of this act; and all subordinate officers
shall yield entire obedience theaeto; and
fee officers commanding brigades, regi-
ments, and compaizies, shall have the
salne authority within their respective
commands ; but whenever either of them
shall find it necessary to order out the
force his command, he shall forthwith
despatch intelligence of such order, and
the occasion thereof, together with all
account of his movements and operations
I.) the commander in chief, or to any oth-
er of his superior officers, as he may deem
iiiost conductive to the public safety, and
the officers receiving such intelligence,
shall observe the same line of conduct,
in order that the information may, come
to the commander-in-chief; and when
any company, regiment, _brigade, or the
division of the militia in this state, shall
be ordered into service by the proper of-
ficer, on any alarm, each non coniniission-
ed officer musician, and private, who neg-
lects to appear at the place of rendez-
vous, iii person, or by substitute, und join
the company to which he belongs, shall
for such neglect, pay a fine of seventeen
dollars, and shall pay the further sum of
twenty dollars for every month that he
shall neglect to join such company, and
in the same proportion for a longer or
shorter time; and upon neglect or refu-
sal to pay said fine and forfeiture, he
shall be imprisoned ill the common jail
in the county where he resides, not- less
than thirty nor more than sixty cays, at
the discretion of the court before which
the conviction is bad; and each lion-
commissioned officer, musician and pri-
vate, shall have the same notice when
ordered into service, by coinpany,battal-
ion. regiment, brigade, or division, as is
provided in this chapter for those who
are called out by defacliments.
SEC. 64. The commanding officer of
each company shall, immediately after
a detachment, company. regiment, brig-
ade or division, shall be ordered to ren-
dezvous for service at any particlilar
lime and place, make return of the names
and places of abode of all the persons un-
der his command, who shall have incur-
red any of the penealties provided in the
next preceding section of this act, to the
brigadier major of the brigade, to which
they respectively belong; and the brig-
ade major, within tweniy days from the
time of his receiving said return, shall
' make a like return to the State Attorney
for the couniy_in which such person or
pcrsous may reside.
Size. 65. The several county courts
may hear and determine all actions for
any violations of the provisions of this
chapter; and the state attorney in the
several counties, may prosecute the same
by action of debt, in the name of the state
treasurer, or by information in behalf of
the state; and when said fines and for-
fciliires are received, they shall pay them
into the State Treasury.
SEC. 66. Every sergeant, corporal, mu-
sician, and private of the militia, that
shall be detached to perform a tour of
military duty, under the authority ofthis
state, or of the United States, may pro-
cure a substitute, of equal grade with
himself to be approved and accepted by
the senior officer in command at the place
of rendezvous who shall be the only
proper officer to approve and accept a
substitutes and to deferinine on their
qualifications; and such officer shall not -
accept. a substitute, unless he is complete-
ly equipped and in uniform, according to
law; and such substitute, when accept-
ed voluntarily enrolled, shall be subject
to the laws of this state, for forming and
conducting the military force, while in
actual service.
SEC. 67. The counnandiilg officer of
the conlpziny from which any detach-
lnem. is made, shall give immediate no-
Licc thereof to the person or persons de-
tached which notice shall be in writing,
signed by such officer, and shall be read
ill the heari,ng'of the person detached, or
an attested copy of it shall be lgft at his
usual place of abode, by one of tlie,.ser-
genius of said company; and whenever
any sergeaiit, corporal, musician, or pri-
vatc, detached and notified as aforesaid,
shall refuse or neglect to appear ill per-
son, or by siibstitute approved as afore-
said, at the lime and place appointed for
the rendezvous of such lletacliuicnt, he
shall the sum of twenty dollars to the
slate, and pay to said treasury the fur-
l.ll(5l' sum of twenty dollars for every
month that he shall neglect to join such
and in the same proportion for any part
of the time he shall neglect to join the
do-taclinicut; and upon neglect or refusal
to pay said penalties, he shall be impris-
oned in the common jail of the county
where he resides. for a temi not less than
Llllfly days not exceeding sixty days, at
the lfiscrction of the cowl. before which
the conviction is bad. '
SEC. 68. When any penalty shall be lu-
cnrrcd by ally minor, for a violation Of
the sixty-third or. sixty-seveiuli section
of this act, the parent, guardian or inas-
ter of such minor shall be liable for the
same, unless such parent guardian, or
niastcr,slial| make it appear lhat lie was
not aiding in, or consenting to such lieg-
lect. or refusal.
Sec. 69. When the militia or any‘de-
dclaclliiieii thereof, shall bc called illlo
actual service, under the provisions of
this act, they shall be emitted to the
.~"dll‘le pay and rations as the army of the
United Slates.
Size. 70. Any officer or soldier, woun-
ded or disabled, and the widow and chi].
(lieu of any officer or soldier killed, while
in the service of this State shall be snit-
ably provided for by the Legislature.
SEC. 71. If any person, holdinga coni-
iiiission ill the militia of this State, and
detached to hold himself in readiness for
service, by virtue of any law of the Uni-
ted States, shall during the period for

CHAPTER IX.
Of Courts Martial.
SEC. 72 General, field, commissioned,
and slaffofficers, shall, for disobedience
of orders, unofficer like conduct while on
duty. or during ally day appropriated for
military exercise or parade, and for neg-
lect of any duty imposed upon them as
officers of the militia, be subject to trial
by general court martial, according to
the usage and practice of war; which
court martial shall consist of not less than
seven members; and the senior officer,
who shall always be of a rank superior
to the officer on trial, shall preside. A
court martial for the trial of an officer un-
der the grade of a field officer, shall be
appointed by the commanding officer of
the brigade to which he belongs; for
the trial of a general officer, by the com-
mander inchief; and in every court mar-
tial there shall be a judge advocate, who
shall discharge the duties of that office
according to the usage and practice of
courts martial ; and no other person shall
be admitted to prosecute or defend the
arrested officer.
SEC. 73. \Vhenever a court martial
shall be ordered, the order shall desig-
nate the time and place of— holding the
same, the mime of the officer to preside,
and the number and rank of other offi-
cers, of which the court. is to be compo-
sed; and if the court shall be ordered by
the commander in chief, the order shall
be signed by the commander in chief‘, or
by the adjnlant general, and shall be of
the teller following, to wit:

General ordering said court; and for a
brigade court martial, the brigade major

SEO 75. If the officer to be tried shall
be :1 general officer, he shall be furnished
with a copy of the order for said court,
and a copy of ilic chargesin arrest by the
Adjutant General, or by a division or

SEC. 76. The Judge Advocate shall
summon or cause to be summoned, such

of taking such depositions shall be given
to the prosecutor and the accused.
SEC. 77. The members to compose the
court shall be detailed by seniority, in
regular rotation of duty; and all charges
in arrest shall be made out in due form,
by way of complaint, and signed by the
party complainiing, addressed to the offl-
cer whose duty it is to order the court,
specifying the act or neglect of which
the accused is supposed to be guilty, and
poyiiig due process before the said officer
shall order a court martial for the trial of
the accused officer.
SEO. 78. The members of the court,
before they enter upon the trial any per-
son accused, shall take the following
oath, to be adininistered by the Judge
Advocate, to wit :—“Yon swear that you
will truly try and determine, according
to the evidence given in court, the mat-
ters depending between this State and
the officer or officers now to be tried ;-—
that you will not divulge the sentence of
the court, until the same shall have been
approved or disapproved according _to
law; neither will you, at any time, dis-
close the vote or opinion of any nlembcf
of the court, unless required by due course
oflaw; so help you God." All other
oaths which may be necessary to admin-
ister during the court, may be adminis-
tered by a general or field officer, or by
the J ridge Advocate.
SEC. 79. A Judge Advocate for each
county shall be appointed and commis-
sioned by ilic coniiiiander in chief, and
shall do the duties of that office in all
court inaitials assembled and field in the
county for which he is appointed. _
SEC. 80. The Judge Advocate shall
take the following oath, to wii:—"You
swear that you will not, at any time
whatever, disclose the vote or opinion of
amt ineinbcr of any court martial, in
which you may be called to act, unless
required by due course of law : nor di-
vulge the sentence of any such court,
unless the srme shall have been appro-
ved or disapproved purslialit to law ; and
that you will faithfully and impartially
do the dulv of Judge Advocate. i|CC0l'd-
ing to your best abilities; so help you
God.” Which oath may be admliiiste-
red by any judge or justice of the peace,
and a certificate thereof shall be made
by such judge or justice, on the commis-
sion of the judge advocate, sworn as
aforesaid; and the Judge Advocate so
appointed and sworn, shall hold his office
during the pleasure of the coirirnander in
chief.
SEC. 81. \Vhenever the Judge Advo-
catc of the coumy, by reason of interest,
or by reason of relationship beuvecu him
and airy other officer to be tried, or of
any other cause, cannot. act. in ally court
iiianial to be assembled and field in the
county to which he belongs, the officer
ordering the court may designate and or-
der the Judge Advocate of any adjoin-
ing county to officiate in said court, mar-
tial.
SEC. 82. If, on trial, the accused shall
accept against ally one or more of the
members of the court, he shall state the
ground of his objections, and if it shall
appear to the court. sufficient, the mem-
ber or members objected to shall leave
their seats; and if the number remain-
ing shall be less than five, the court, shall
be adjourned for a reasonable time, that
the officer appointing the court may de-
tail others to supply the place or places
of such members.
SEC. 83. No court mafiial shall order
any other punisliment than zi not excee-
ding one hundred dollars, and a repri-
mand, or either; or a fine not exceeding
one hundred dollars, and cashiering, with
disability of holding any military office
ill the State or either of these punish-
ments; and two-thirds of lively court
shall concur in every sentence.
SEC. 8-1. If any officer under arrest.
shall refuse or neglect to attend a court-
iiiartial, according to orders. and 1103303
given to him, he shall be seiiteiicedby
said court. to pay a fine not exceeding
one hundred dollars, and to be cashiered
with disability of ever Iioldiiig any mili-
fary office ill this State, unless prevent-
ed by sickness or some other reasoiiable
cause from so attending; in wliich case
the calm, may udjoiirii, and notice there-
of shall be given by the Judge Advocate
lo we an-esled officer, at least ten days
to which the court is adjourned.

and the record of the proceedings and
sentence of court martial, in every case,
with the order approving or disapprov-
ving the same, shall be deposited in the
Secretary of State.
SEC. 90. It shall be the duty of the
Adjutant General to cause this act, to-
gether with the act of Congres respect-
ing the Militia, and also such formsjof
orders, returns. &c., as be may consider
necessary, to be printed in pamphlet form
at the expense of the State, and to distri-
bute one copy to each commissioned afi-

SEC. 9]. “Cooper’s Abstract of Scott’s
Tactics for the regulation of the Militia,”
is hereby adopted for the use of the mili-
tia of this State, and all exercises and all
manoeuvres shall be in accordance there-
with ; and a copy of said work shall be
furnished by the Adjutant General, at the
expense of the Slate, to each command-
oflicer of the companies, and to each
General Field, and Staff officer.
SEC. 92. This act shall take efl’ect
from and after the first day of October,

SEC. 5. When the lands or other property or
estate or any femme-covert, infant, or person

construction of such plank road, said lands
may be taken, notice being given to the bus-
band of‘ such fcinme-covert, the guardian of
such infant, or the COI]SCl‘Vnt0l'_0f such person
non-composnientis. And sucli husband, guar-
dian or conservator may release all damages
for any estate taken and appi'opriated_ as afore-
said, as he might do if said estate were held by
him in his own right.
Size. 6. Whenever it may be deemed neces-
sary, such plnnk road may be located and con-
structed across, along, or upon any water-
course, stream, road, highway, or turnpike
road, or over or under any railroad ; Provided
that such corporation shall so far restore to his
former state. such water-course, stream, road,
highway or turnpike road, crossed or used by
them, as to leave its usefulness unimpaired.
Sac. 7. Whenever such corporation shall
have completed the whole or any four consec-
utive miles of their plank road, they may ap-
nly to the County Commissioners of the coun-_
ty in which the same is located or any two of
mom, to inspect said road or said part thereof
