An Act relating to the. Ferry at Middletown, and

SEC. 1. The Fei'r_v across Connecticut river
between the towns of Middletown and Portland,
shall be IIHl‘lnl:ill'ted exclusively by “'l‘iu: Min.
nnxrowiv P mun‘ CoMr.uvv,” hereinafter incor-
porated. and the said: company shall have, pus.
‘9‘¢S_=| and enjoy the said ferry with all its appur-
te_nanc_es and privilegges in as full and ample a
manner and with the same powers as they have
been heretofore possessed and enjoyed ‘by "The
Colchester and Cbathain Turiipike Company,’
and those claiming under it, under the provisions
of the .l3_tll section of the 16th title of the Re-
vised ‘Statutes, entitled “An Act relating to Fer-
ries." Ami the said company shall become
bound to the Treasurer of the State in the sum
of five thousand dollars with surely to his accep-
tance, to maintain said ierry,as provided by law;
and said company shall at all‘times provi-le a
ferry house sufficieiit for the iiccommotlation of
[those who cross said ferry, on each side of said
ferry and neat’ thereto, witti sufficient land for
landing placesysuitublc docks and every thing
necessary .'-1tlLl convenient for the transportation
of passengers, carriages, stages, other’ vehicles
over said -‘ferry; and instead of the liorse boat,
Ii9_w__in,use at said ferry, the proprietors thereof
shall-be required to pro:-.ui'_e as soon as may be
‘i'e‘;asona"bly practicable during the present year,
and there-i fter to run and operate at said ferry. a
good and sufiicient steam feri-_v boat or boats ade-
quate in respect to size, power, steadiness and
speed, for the safe and rapid transportation of all
{passengers and whatever else may be necessary
to be transported in said boat or boats across said
ferry and also provided with proper arrange-
ments for the shelter of foot passengers; which
boat or boats shall be kept in-crnstant readiness
during the hours when said t'c-rizv is required to
be in operation, to transport passengers and
whatever else may required to be transported ;
and said steam ferry-boat or boats shalt be regu-
larly_ and ‘v‘igil-aiitly attended, and shall ply in
such a manner as shall in the opinion of the coin-
missioners on said ferry, accomiriudate the public
in a reasonable and sutlicient inanncr.
Sec. 2 The Senate shall annuallyappoint two
xohimissioners on said ferry,whosednty it shall be
“as often as in their opinion the public good shall
require it, carefully to inquire into the manage-
ment of the said ferry; to inspect the boats. ina-
chinery, engines. piers, wliarves, landing places
ferry houses,and all other things appertaining
thereto, and to see whether said ferry is kept
and tended in all respects according to law; and
-‘ifsaid commissioners shall at any time find that
said ferry or anything belonging to it, is in any
respect not kept and inai:itained according to law
they shall nottfy said company in writing of such
defect or deficiency and order said company to
cause such defect to be repaired or deficiency to
be supplied acc.ora.ling to law, within a i'easoiiii-
ble time to be limited in such order; and if said
order is not complied within the time limited
therein. may cause the bond of said company to
,.be_ put in suit, or other proper proceedings insti-
tuted against said company.
SEC. 3. The said fe’rry shall be kept open and
in operation from sunrise until 10 o'clock at
might from the first of April to the first of Octo-
ber in each year, and until 8 o’clock at night from
the first of October to the first of April; and the
ferryinen employed there-at shall not deny or de-
lay the speedy carrying over of any passenger,
his team cattlc.liorses, or other creatures; pro-
vided that the said ferrymen shall not be requir-
ed to attemptvto pass said ferry when it manifest-
:ly appears to be hazardous to do so by reason of
storm or ice; and further provided that until a
steam ferry-boat is procdred as before required,
the hours of operating said fel‘l‘_V shall continue
the same as at present.
SEC. 4. Stephen Brooks, Evan Davis, Joseph
Bacon and Norinan Smith, being the present
proprietors of the Mi ldletown Ferry under the
rovisions ofthe 13th section ofthe 16th title of
the Revised Statutes, together with such persons
as may be hereafter associated with them as here-
in provided, are hereby incorporateil for the pur-
pose of operating and conducting a steam ferry
between the city of v.‘/liddlctown and the town of
P0f']l.-Ind, by the name and style of “ The .Mi't1dle~
(own Ferry Conipmiy,” and by that name shall
be at. are hereby made capable in law to have_, pur-
.¢_-nase, receive, possess, hold &. enjoy to them and
their successors, land, rents. franchises, tene-
ments, hereditaments, goods, chattelsand effects
of ivliat kinds and quality soever necessary or
' expedient to give effect to the specified purpo-
ses ofsaid company, or for the accomrnodation of
their concerns and business, and the siine to sell
demise, grant, alien and disposed of; to site and
"be sued, plead and be implearled, defend and be
"defended in all courts in this State and ‘else-
where; to make and have a common seal, and
the same to break, alter and renew at pleasure ;
also to make. ordain, establish and put in execu
tion such by-laws, ordinances and regulations as
m.i_v be deemed nu.-ce.<sar_v and convenient for the
well ordering and government of said corporation
and carrying into effect the provisions of this act
and not contr-.iry thereto. nor to the constitution
or laws of-this State or of the United States.
Sr.:c.5. 'l‘he capital stock of said company
shall consist of ten thousand dollars, with the
privilege of irici'easiiig the same to twenty thou-
sand ’dollars, to be divided into shares of one
hundred dollars each, which shares shall be
i1'el‘SOttal property, * and be traiiferrable in
such manner as the by laws of the compa-
ny shall prescribe. Whenever the said Ste-
phen Brooks, Evan Davis, Joseph Bacon and
Norman Smith shall have executed and deposi-
ted in the office of the town clerk oftlie town of‘
Middletown a deed or other proper instruineiit
conveying and traiisferring to said company all
the rights, privileges. franchises, lands, tene-
ments. boats, horses and all other property what-
soever, belonging to or held by them as proprie-
iers ofthe Middletown Ferry, and the said orig-
tnal capital of ten thousand dollars shall be deem-
‘ed to-be paid in full and shall be held by the
said‘ corporators in the following proportions,
viz: foi'ty-fiveshares by the said Stephen Brooks,
-fifty shares by the said Evan Davis, four shares
byihe said Joseph Bacon, and one share by the
said Norman Smith.
; SEC. 6. If the said company shall see fit to in-
crease their capital stock as herein provided,
Inch additional stock shall be divided among the
members of said company in proportion to the
stock then held by them, and the directors may
call in the amount of such new capital by instal-
ments in such proportion and at such times and
places as they shall think proper, by giving such
notice thereof as the by-laws shall prescribe;
and in case any stockliolrler shall neglect or re-
fu'se payment of any such installment for \the
spaceof sixty days after the same shall have be-
conie due_ and payable and after he shall have
been notified thereof, the stock ofsuch negligent
itockholder sh".-.ll be sold by the directors at pub-
lic auction, giving at least thirty days notice
th’ei"eofin some newspaper published in the city
of Middletown, and the proceeds of such sale
shallfbe-firstapplied in payment of the install-
,ment.called for. and the expenses attending the
‘call and sale and the residue shall be refunded
to the owner thereof, and such sale shall entitle
the purchaser to all the rights of a stockholder
to the extent of the shares so bought.
Sec. 7. The government and direction of the
affairs-of said corporation shall be vested in’:
board of not less than three directors, who shall
be annually chosen by the stockholders at such
time and place as shall be provided by the by-
laws,’ of. said company and ‘who shall be stock-
holders. and shall hold their ollioe for one year
and until others shall be chosen in their "stead.
_Until the first annual election of directors, the
. saidstephen Brooks and Evan Davis shall be
solo directors of said company; provided _that
the first meeting for the choice of direc-
torsshall be called by the said Brooks and Da-

SEC. ll. if it shall so liappen tliatan election
of directors shall not ‘take place at the arnual
meeting "in any year, said company shall not
thereby be dissolved, but an election may be
had at any time within one year, to be fixed up-
on and notice thereof to be given by the direc-
tors. -
Sec. 12. The books of said company contain-
ing its accounts, shall at all reasonable times be
open for the inspection of any of the stockhold-
ders, and as often as once in each year a state-
ment of the accounts of said company shall be
made by order ofthe directors. - ,
Soc. 13. So much oftlie “Act relating to'Fer-
rips" in the Revised Statutes as is not hereby re-
pealed or inconsistent herewith, is declared to
be and remain applicable to the said ferry.
Sec. 14. The 13th section of the said “Act re-
lattng to ferries" is hereby repealed: provided
that until 2. steam l'ei°i'y-boat is procured by
said company as herein required, they shall con-
tinue to provide the accommodations at said fer-
i'_v required in said section.
SEC. 1.’) This Act shall take etTect from the
date of its passage, and may at any time be
amended, altered or repealed at the pleasure of
the General Assembly. '

extreme penalty oftlie law in the Court House
at Pouglikeepsie, on Friday last. The fut-iiier
was convicted oftlio muider of her husband.
Nelson Hoag, in the latter part of June. 185i,
and the bitter oftlie murder of his .-etep—cliild by
the commission ofa rape in January last. The
woman was 31 years of age. and the negro 27.
Bot li declared their innocence, and inarclied to
the gallows with firm steps. The woman was
convicted ofpoisoning lier liusbnnd, and although
she admitted he died from the effects ofarseuic,
she denied her guilt. There are many inter-
otiug featuies in her case. She was it woman
of noble tipp0flI‘tltlCf‘, naturally shrewd and iii-
ts ligenr, i:ut witlioiit: education. The bodies
of the two were that evening buried in the
Grounds attached to the Court-House.

Foo-rm Daowiuzo.-—-Tlie body ofan unknown
man was found on the beach at Shippnii Point
on Fridity week. He was apparently about 98
years ofage, 5 feet 6 inches in height, dark,
'orowii hair and wliiskors. He was entirely na-
ked and had apparently been in the water sev-
eral days. A coroner's inquest was held on Fri-
day night.

firing the barn of Samuel Scribner, in Miry
Brook,oii the 2d of December, was arrested in
\Ve.'~l:poi't on the 19th iiist., by Deputy Sheriff
Morris. He was ariaigiietl before Justine Jen-
nings of D.-mbury, on Saturday, when the cir-
cumstantial evidence adduced from the testi-
mony was deemed siifiicient. to warrant a coin-
iiiihieiit. and lie was bound over in the sum of
3300 to appear at the August Torin of the
County Court.
