No. 3:}. An Act; in addition to an Act entitled
“An Act against Fraudulent Coiiveyaiicz-s.”
Be it enacted, &r., That wlieiiever_an_v per-

son or persons shall have in his or_their custody

and possession or under his or their ‘control any
goods or chattels belonging to the assigned estate
of any insolvent debtor, or any hills, bonds, notes,
accounts or any other thing belonging to said
estate, whether claiming any lien thereon or not,

a id on demand of the same by the trustee of

said estate, shall refuse to deliver them or give

a satisfactory account thereof to said trustee, or

in case he or they claim to have any lien, shall

"refuse, to disclose the amount of his or their claim

thereon, and when and how the same accrued,

and all particulars in relation thereto, or shall

refuse to exhibit any document or writing relat-
ing thereto or to l‘U]‘.l]l>‘l.1 to such trustee an in-
veiitory of such property upon which he so claims
to have alien, or to give to such trustee and the
-zippi'aisei's reasonable access to such. flS.;lglit‘(l
property, that they inay may make an inventory
thereof, it Sllltll be l:iwful- for the judge of the
Court of Probate in which such estate is pending
for scttleiuent, upon the application of said trus-
tee to issue a citation, and cause such person or
persons to come before him—and such Court
shall have power to examine him or them on
oath fully and pzirficularly concerning all the

persons shall neglect or refuse to appear before
said Court whenever 1-equired by such citntioii,
or having appeared, shall refuse to be _examined
on oath and to answer the interrogatories put to

access to said assigned property for the purposes
aforesaid, it shall be lawful for the court to isstle
a warrant for the commitment of such person or
persons to prison, there to remain until _he or
they shall coaforrn to the law or be otherwise le-

said trustee and be recoverable b_v him in the
same manner as by executors and adiniiiistrators
in similar proceedings, as provided by “An Act

No, 33. An Act in addition to an Act entitled
“An Act relating to liigiiways.”
Sec. 1. Be it (’N—(lCf(’(I. S;n., That the select-

mea of the several towns in this state may give
permission in wi'iliii_'2; to any owner or owners of
land adjoining a public higliway, to set out or
rel.-aiii any fruit, forest, or ornamental tree or
trees‘, in any‘part of such higliway, where they
shall judge it will not interfere with the p_ul.»_lic
_ travel on such liigliway, and such pcruiissi(_iii
having been recorded in the records of lands in
such town, such owner or owners shall liave the
right of setting out and retaining such tree or
trees, and to protect the same by suitable posts
and stakes; and such trees, and such posts and
stakes shall not he removable except by ordi.-r of

the Selectmen, when such removal shall become _

necessary for the proper repairing or grading of
such highway.

Sec. 3. If any person shall cut down, Pllll “P.
girdle or 0ll1Cl".\'lSC injure, or destroy any such
tree or trees, without permission of the owner
thereof, he shall on conviction thereof, pay a fine
of not exceeding fifty dollars for each tree _so cut

‘down. pulled up, girdled, destroyed, or injured;
and if any peison shall cut down orr_emov_e any
such stake or post‘, without the permision of such
owner, on conviction thereof, he shall pay a fine
of not exceeding seven dollars for each stake or
post so cut down or removed.

Sec. 8. If any person shall cut down, pull up,
girdle, or otherwise injure or destroy any tree,
growing on any public square or grounds, with-
out the consent of the city or town, where the
sauie are situated, such person so offending, upon
conviction thereof, shall pay a fine not exceed-
ing the sum of fifty dollars.

“An Act providing for the care and govern-
merit of Idiots, Lunatics, and Speiidtlirif't.s._”
Br: it en/zcicd, S,~c., That in all cases in which

t.lie selectmeii of any town in this State have ap-
pointed, or shall hereafter appoint an overseer to
any person residing in such towu,agi‘ee:_ible to
the sixth section of the act, to which this is an
addition—and in all cases in which pi-oceediiigs
have been or may hereafter be had_ iiiidei' the
provisions of the seventh section of said act; and
such person shall have removed from said town,
and become a resident of any other town in this
State; said selectmen, or their successors in of-
fice, may re-appoint said overseer, or.may ap-
point some other suitable person to said place,-
and may also institute proceedings under _the
seventh section of said act, before any two jus-
tices iii such town and said justices may proceed
in all respects as they inigbt have done had such
person not removed from said t.owii, all which
proceediiigs shall have the same force and effect
they would have had in case said person had
continued to reside in said town.

Provided, That whenever the person so siih-
ject to an overseer shall have gained a se.t.tlem_ent
in any town in this state other than that in which
such overseer was appointed, no reappointment

of an overseer in the manner provided in this,

act. shall thereafter be made. Providctl also,
that nothing in this act shall be so construed as
to affect any suit; now pending.

No. -1?. An Act in addition to and in alteration
of an Act entitled, ‘:An Act for forining and
conducting the Military Force.”

SEC. J. 3:: it enacted, «fyc., That all able-ho-
died, white male citizens, between the ages of
eighteen and fliii-t_v-five years residing in this
state and not exeiiipted by the laws of the United
States and the provisions of this act, shall be
subject to military dut_v, exceptin_r.:———

1st. Officers of the army'ofthe United States;

2d. Miiiisters and preachers of the Gospel;

(hf. Licr,~nsed pli_vsiciaiis and surgeons, while
they continue in practice; ,

«fth. Persons who have been or hereafter shall
be regularly discliargetl in oo_nsequence of their
performance of rnilitary duty, in pursuance of any
law of this state, and such firemen as are now
exempt by law;

.")th. Commissioned officers who shall serve as
such in the militia of the state, or in any other of
the United Stites, for the space of five years;
but no such officer shall be so exempt, unless by
his resignation, after su-:-.h term of service, duly
accepted, or in some other lawful manner,‘ he
shall have been honorable discharged;

Treasurer, Secretary, Comptroller, and Commis-
sioner of the school Fund ;

7th. The officers and attendants at the Retreat
for the liisaiie in the town of Hartford, who are
permanently ciigageil in the immediate care of
the patient of that institution, of which said en-
gagement a certificate from the superintendent
of said institution shall be evidence.

SEC. 2. A91 able bodied, white male citizens,
between the ages of ciglitecn and thirty-five
years, not exempt from military duty by the laws
of the United States and the provisions of this
act, shall he enrolled by the collector of state
taxes in the town in wliich they shall respective-
ly reside, who shall without delay notify such
persons of their enrollment, by leaving a printed
or written notice ofthe same at their usual place
of abode, and shall report the same in an alplia-
betical list to the commander of the regiment,
within the limits of which he shall reside, on or
before the first day of March in each year. And
such commanding officer shall cause the name of
all such persons enrolled to be entered alphabet-
ically in a book to be kept by him for that purpose
desigiiatingflie date of each enrollment and place
of residence, and shall annually report the same
to his Brigade Inspector; to enable him to report
the same to the Adjutant General. And all able-
bodied, white male citizens between the ages of
eighteen and forty-five years not enrolled as
aforesaid, shall be enrolled and reported to the
Adjutant General as military exempts in the
same manner as is provided in this section f'or
military subjects.

SEC. 3. All persons, except commissioned or
warrant, oflicers and members of uniform compa-
nies duly organized, may annually commute for
military duty by paying to thejcollector of state
taxes, in the town in which he re.sides, the sum
of one dollar, between the first day of January
and the first day of May, in each year. Such
collector shall give duplicate receipts therefor,
and such receipts or his return thereof‘ shall be
the sole evidence of such exemption. And where
one of such duplicates shall have been delivered
to the commandant of" the regiment within the
bounds of which such person shall reside, such
persons shall not be returned or fined for any de-
linquency or deficiency in rendezvous, parade or
trainirig during the year in which such certificate
was given.

SEC. 4. Any person subject toinilitary duty,
and who shall have been enrolled and duly noti-
fied thereof, who shall neither volunteer into
some uniforrn company, nor pay the collector of
state taxes inc commutation of one dollar, as is
provided» by the preceding section of this act,
shall pay a fine of four dollars; to be recovered
by war-ant from the commanding officer of the

Size. Every white male citizen over the age
of eighteen years, who has been orshall hereafter
be enrolled as a volunteer, and has equipped or
shall equip himself with uniform and rcgulaily
perform military duty in accordance with the
provisions of this act, shall be exempted froin
poll tax during such service; and after having
served ten years shall ever after be‘ exempt from
mi!itary duty, except in cases of war and insur-
rectioii.

Size. 6. The state shall constitute one military
division district, which shall he commanded by a
major general, and shall be subdivided into _two
brigades as follows, to wit :

1st. The counties of Hartford, New London,
Tolland and Windham shall be and constitute
the first brigade district,

2d. The counties of New Haven, Litclifiehl,
l\liddlcse.\: and Fairfield shall be and constitute
the second brigade district; and each brigade
shall be coimnanded by a brigadier general.

SEC. 7. The state shall be divided into eight
l'I"g‘ltllCl\lt1l districts, the boundaries of which
shall be the same as the boundaries ofthe differ-
ent counties in the state; which said boundaries
may at any time be altered b_v the captain gene-
ral at his di.-:ci'etion; and each regiincnf. so boun-
ded shall be composed ofsucli uniformed compa-
nies as are at present. duly organi'/.ed under or-
ders from the captaiii geiieral, orsuch as shall be
hereafter oi'gaiii'/.ed.

Size, 9. The captain general shall cause each
company, regiuieut and liizigiiile to be numbered
in sucli manner as he shall deem proper and best
calculated to secure uniforinit_v. Each company,
regirrient‘ and brigade shall be known by its num-
her and designation, which shall be registered in
the adj utant geueral's book.

Size. 0. The captain general shall, within thir-
ty days after the rising of the General Assembly,
cause the commandirig officer of each uuiforin
company in the state to furnish him with an al-
phabefical list of the names of each oflicer, non-
commissioned otliccr, musiciaii and private in his
company, who shall he in full uniform at the time
such list is made. suited to the corps to which he
may belon_:, certified under his oath to be true in
all i'cspecls; which list shall be filed in the adj-
utant general‘s oflicc.

SEC. 10. Any commanding ofiicer who shall
refuse or neglect to make the returns I'eI’1tll1't‘.(l'll1
the preceding section, shall be liahle.to a penal-
ty not exceeding twenty-five dollars, to be paid
into the state. treasury, and to be recovered in an
action of debt in the iiauie of the State Treas-
iirer.

Size. 11. All the commissioned and non-com-
missioued officers, musicians and privates, who
shall be thus returned to the adjutaiitgeneral, as
af'ores:iiil, aiul who shall ‘comply with the pro-
visions of this act in all respects, shall severally
constitute members of the uniform companies
composing each regiinent. And each iiieiiiher of
such uniform conipauy, whose name shall be so
returned and reported to the captain general,
shall be entitled to hold his place and rank in
sucli coinpa'ny——but subject to the provisions of
this act.

Size. 12. To every such company there shall
be one captain, one first, one second, aiul one
third lieutenant, four sergeants, and four corpo-
rals, three inusicians, and sixty-four privates.

chosen from the members of the company to
which they shall belong.

SEC. 1~f. All division, brigade and field offi-
cers, and all other commissioned officers of such
uniformed companies as are at present duly or-
gauized under orders of the captain general, shall
be and remain supernumerar_v.

SEC. 1:‘). The adjutant general shall within
forty days after the rising of this General Assem-
bly issue his orders to each conimaiid:uit of the
i‘espe('tive companie.-: ofcach regiment whose re-
turns shall liave been filed in his office previous
to that time in compliance wiili the provisions
of the ninth section of this act, requiring the
commissioned ollicers of their respective compa-
nies fo convene at some proper time and place;
and when so assembled they shall elect a chair-
man from the officers present, and proceed to
nominate by ballot a colonel, lientenaiit colonel
and major. The person liaviug the majority of
the votes cast shall be elected to the office which
said ballot shall specify; and said chairman shall
make returns of the doings of said convention, to
- the adjutant general, within ten days thereafter;
and the persons so nominated, if any, shall be
commissioned by the captain general, and when
the field officers shall have been returned and
commissioned as afoiesziiii, the adjutaiit general
shall within twenty days f.hereaf'ter, issue his
orders to the field ofiicers of each hi'igade, to as-
semble at some proper time and place within
their respective brigade districts; and when so
convened they shall elect one of their number as
cliaii-man—and said chairman shall lead said of-
ficers to nominate by ballot a brigadicr general
for the respective brigade in which they shall as-
semble The person having a inajority of the
votes cast, shall be elected; and the cli-airman
shall within ten days make return of the doings
of said convention to the adjutant general, and
the person so nominated shall be duly commis-
sioned by the captain general.

Size. 16. \Vhen the couimissioned officers of
. any brigade or regiineiit shall fail to make choice
liof either a brigadier general. colonel, lieutenant
,colonel, or major. or any or all of such officers,
‘the captain general shall be, and is hereby eni-
Ipowered to fill any and all such vacancies in
'such manner as he may deem proper and he is
lhercby authorized and enipowered to commis-
lsion any and all persons who may be duly elec-
’ ted to office in any brigade, regiment, or compa-
!ny, Provziclcrl, however, that the Gcllefill As-
lssembly to which the returns of said elections
islltlll be made, shall approve of the same, other-
‘ wise such commission or commissions so gran-
ted as aforesaid, shall become void and of no force
lafter the disapproval of the General Assembly,
', und all officers commissioned as aforesaid, shall
{take rank from the day of the date of the order
'directing the respective elections to be made.

SEC. 17’. \Vhen after the first election of of-
ficers, uiider this act, the office of'bi'igadior gen-
eral shall become vacant by death, discharge or
oflierwiso, the captain general shall issue an or-
der to such officer as he may designate, belong-
ing to the brigade in which such vacancy exists,
directing such officer to assemble the fieldvaflicers
of the line, mid thebrigade major ofsaid brigade,
at such time and place as he may appoint; and
when so iissembled, to lend them tothe noininii-
tion of ii brigiidior general by ballot, and make
returns of said ineetings to theiidjutam general,
mid when any vacancy shall occur in the field
officers of any regiment by death, discharge, or
any other cause, the captain general shall issue
an order to such field officeras he may designate,
belonging to the regiment; in which such vacancy
exists, directing such officcrto assomblethe field

Size. 20. Alli-oinmissioned and non-commis-
sioned officers shall bochosen by tlieirrospective

ing notice to be given to those eiititled to vote,
that lie is about to lead them to a choice of such
officers or non-couuuissioiied officers, and all
noii-coniniissione-d officers shall receive wari'ziiits
from the coumiauder of the regiment. to which
tlioy belong; who shall have power to reduce
to the ranks such iion-coiniiiissioned officers
whom. on complaint. made and due notice given,
he shall find guilty of misconduct or neglect of
duty.

Site. 21. The captain geiicral shall appoint

Each ln-igadier general shall appoint forliiinsolf

ado a lii'igzule inspector, to serve also as brigade
major, and he shall also appoint; a brigade quar-
ter iuasfer. ~

Site. ‘.22. There shall be allowed to cacliurii-
form company at pi'csont cxistiiig or liereaf'ier
forniod under the provisions oftliis act, twenty-
five dollar.-i per annum, as rent for a suitable ar-
niory in which to pro.~'-ei've their arms and iiiili-
tury cquipirieiits of the state. Such nrinory
shall be under the control and cliargo of the
commanding officer of the company in whose
bound or district it shall be located; and such
eonnnanding officer shall cause to be (lep0sit'e(l
therein all arms and equipniouts received from
time to time for the use of his coinpany, subject‘
to the order of his superior officer. The quar-
ter master geiieral of this state shall furnish,
subject to the orders of the couiniander-iii-elilief
all iieccssary tll‘lI1S and equipinents (suited 10
the particular coinpany or corps lielongiiig to
each reginiont) required for camp and field du-
ty ; the same to he fui'iii.'.-‘lied ut the expense of
the state. The (‘.t)l1lmtltl(lllI_fI officer of encli
company shall be responsible for the safe keep-
ing and return of all arms mid equipments coni-
mitfed to his charge, and shall execiito such
bonds as the quarter master general shall re-
quire froiu time to time; and no company shall

His charges and accounts shall be audited by
the comuiauding officer of the regiment. in wliosc
district he shall reside. The quartet‘ innstei‘
general shall from time to time iual-ze such or-
ders, rules aiul regulations as he may deem

proper for the observzuice of all officers haviiig
charge of any nrniory in which arms of the state
shall be deposited. Any person who shall wil-
fully injure such armory or its fixtures, or any
gun, sword, pistol, occ. or other property of the

state tlierein clcpositcd, shall be deemed guilty

of inisdemeanor.

Si-zc. 23. The quarter nuistor general may
from time to time rcquirc aiiyoflicer to examine
any armory provided as zifori-.-aid, and report to
him the condition tlici'eofnnil of the arms and
camp equipage therein tlG[}()Sll'(’(l.

Size. ‘.24. A (piarter master general shall be
appointed be the Senate. upon the noniiiiatioii
of the captain general, who sluill have the rniik
of lieutenant colonel and shall have nutliority to
appoint. with the ripprobaiion of the captain
general, one or more zissistniits, for whose con-
duct he shall be respoiisilile, and may reinovc
them at. his pleasure. The duty of the quarter
innsfor geiieral shall be to to kc care of all the
public propertycommitted to him and belonging
to his departineiit, to execute all orders received
from the captain general relative thereto, receive

Assembly. And he shall become bound t.o the
state Treasurer, with suretics in ll. bond often
thousand dollars, conditioned for 11 faithful dis-
charge of the duties of his office. -

SEC. 25. A commissary general shall be ap-
pointed by the Senate, upon the nominatioii of

the Governor, who shall have the rank of lien-

tenrnt colonel, and shall have authority to ap-
point, with the approbation of the captain gene-
ral, one or more iissistniits, for wlioso conduct
he shall be responsible, and may remove. them
at his pleasure. It shall be duty of the commis-
sury general to procure supplies for the subsis-
tence of the troops, and issue the same, to exo-
cuto all orders received from the captain gene-
ral, to perform all services that may be required
of him by law, and report to the General As-
sembly, invariably, on the third day of its ses-
sion, the state of this department; and he shall
beconiirbound to the state Treasurer with sure-

Size. 52f‘. A paymastcrgeneral shall be ap-

of his office. And in case either of tho olliccs

ring the recess of tho Geiieral Asssoiiilily, the

shall hold his office until the session of the Gen-
rnl Asseinbly iiext after subh appointinent.
3 Sicc. £27. Eacli colonel of the several regi-
' uients shall appoint oiio adjufant, one paymastcr,
one quarter master, one chaplain, oiio surgeon,
tono surgeoii’s iiiatc, one sergoaiiit. major, one.
' quarter iiiasfer’s sergeant, one drum inajor, one
life inajor. and one trumpet major; all which
zippoiiitiiieuts shall be published in orders. He
shall also issue. tl warraiit to each person who
may be elected by any company under his
coiiimziiid to the post of sergeaiit or corporal,
and in case any conipany shall fail to elect any,
or all the wai'i'nnf; officers iiecessary for said
|(:()l])l)tllly. us is provided by this act, he shall is-
: sue fl wai'raut to such member ofsucli company
as ho may deem proper.

Size. 28. Every officer of the line and staff
and every officer and private of any iiiiiforni
coinpany in the state shall provide liiinsclf with
:1 iiiiiforui complete, which shall be such as the
coniniaiider in chief sliiill prescribe, and subject:
to such i'esfrictioiis, limitations rind iilteratioiis as
he may order.

SEC. 29. There shall be one parade in every
year, between the 15th day of August. and the
1st day of Noveinber, for three consecutive
days, by regiiiient or brigade, as the coiiiiniiiid-
ing officer of the division shall deem expedient,
for the purpose of oiiciiiiipnieiit, training, disci-
pline, inspection and review.

Size 30. The couiiiianding officer of each
.brigadc shall order the troops under his coin-
inaiid to pai'ade for the above purpose at such
tiiine between the fifteenth day of August. and
the first day of Noveinber in each year, to c0iii—
inence on any Tuesday therein, as he shall deem
proper, and in the following order:

1st. The commissioned, non coiiiiiiissioned
officers and niusicimis of any rogimeiit or brig-
ade, or the different. corps tlieri-.of', as shall be or-
dered to appear at the places appointed for such
parade, shall meet at 11 o’clock in the foreiiooii,
and shall not leave without perniission until thr-
close of the parade on the third day thereof.

2d. All the uniformed privates of each coin-
pany belonging to each regiiiient or lii-igiide, or
the differciit corps l3l10l‘eOl,tlSl1l'lC case may he,
shall nieet‘. the officers of their respective coin-
panies ct such parade, on \Vediiesday, the sec-
ond day thereof, in their respective unifornis at
10 o'clock in the forenoon of that day, and shall
notlenve without permission until the close of
the parade on the third day thereof.

Size. 31. The coiuanding officer of the day,
at any such parade, may cause those uiiiler his
eoinniaiid to porforin any field or camp duty he
shall require, and also to put uiidor guard for
the day or time of coutiiiuing such parade, any
officer or soldier who shall disobey the orders
of his supcrioi'0fficor, or in nuywise interrupt
the exeercisos of the (lay; also all other persons
who shall trespass on the parade ground, or ii:
any way interrupt. or molest the orderly dis-
cliurgo of duty of those under arms.

Size. 32. All orders foroiic.'iuipineut, inspec-
tion and review shall be published at least twenty
days previous to such parade, and all command-
ing officers of companies may on any parade,
read brigade or 1‘t'{J;ltllOnlLtll orders, and notify
the soldiers nnd officers of their several coin-
iniinds to appear as spee.fie(l in said brigade or
regimental order. for the purposes therein coii-
tained; which notice shall be $1 sufficient
warning to all sucli officers and soldiers as are
present.

Sec. 33. Ever ' officer, non--commissioned
ofliccr, inusician and private of any uniform
coinpany, who shall unnecessarily neglect to
a ppoar on the days and at the time and place
appointed for such duty, agreeably to the provis-
ions ofthis act, shall forfieit his annual pay, also
forfeit and pay two dollars for acli and every
day for such neglect; and the ccrtificntze oftlie
commanding officer under oat.h of any conipany
shall be received as competent evidence of such
neglect. or refusal to do duty as above pl‘0Vl|.lL‘.ll,
or any other duty required by this act.

SEC. 34. The commanding ofiiccr of ever’
company in t.his state shall, after each and every
parade required by law, make out alpli:ilwticul
lists of the names of the persons, who shall have
appeared armed, uniformed and equipped accord-
ing to law, and performed duty in his company
on each day of said parades stating the town
land county in which such persons re.-peetiveiy
reside, and shall within ten days after such pur-
' ado, deliver the same, (certified under his oath

to be true and correct in all respects) to the coni-
- mander of the rogiiiient to which such compa-
, ny belongs, and shall leave ii copy thereof with
j the l’.l'(‘.t1Sl1l‘e1' of the town in wliich such coin-
'pany is located.
3 Size. 35. The comnuinding officer of each

regiment to whom the retui-ii in the preceding
;section is made, shall, on or before the fifteenth
; day of November, annually, iruike out 8. complete

list; ofzill the persons in his roginicnt, who shall

appear from said rolls to be entitled to be paid
for militia service, and shall return the same
. to the adjutant: general on or before the first. of
~Deceinbor, annually. And after the per diem

allowance shall be fixed bytho adjutant. general,
land after the first day of Jaiiuary, and on or be.-
fore the first day of February, annually, said
comiiianding officer shall draw his wai'i-aiit on
: the ti'easurei' of this state directing him to pay

the treasurers of the several towns within the
=]imits ofliis command, the amount due to the
persons residing in said towns respectively; and
the treasurers of the several towns are hereby
authorized and directed to pay the amount clue
the persons residing in said towns, after the first.

‘SEC. 36. Ariy officer who shall neglect to
make the returns required in the preceding sec-
tions, shall be liable to u penalty not. exceeding

Size. 37. All coinmanding officers of regi-
nients shall annually, on or before the first
day _of Deceniber, transmit to the adjutant

draw his warrant on the treasurer, directing him
to pay the uiuount due the pergqns named in
the said roster or lists, utter the ndjutunt
general shall have fixed the per diem allowance
each shall be entitled to receive.

Size. 38. And such commanding officer who
shall refuse or iiegloct. to make :1 correct return
as required in the preceding section, shall be
liable to a penalty of not exceeding fifty dollars,
to bepaid into the state treasury, and to be re-
covered by nu action of debt in the name of the
state 'l‘reiisui'er.

SEC. 39. The coiiiiiiniidaiit of every compa-
ny shall cause his non-eoinmissioned officers to
warn personally, or by leaving at their usual pla-
ces of abode ii notice, all or any part of his com-
pany to any parade ; and if such notice be given
three days before any parade, shall be deemed
sufficient. notice. .

Size. 40. There shall he paid for services
reiidered, annually, as directed by this act, not
to exceed the suius as follows: to every com-
missioned aiid non-comniissioned officer, magi"-
ciaii and private, as specified in this not, while
actually engaged in full uniform, on parade and
duty, vi:/.: To all field, coniinissioned, and reg.-
iineiital staffofificers, and ‘to ull iion-comiiiissioned
officers, inusicians and privates of any uniform
corps organized in pursuance of this act, for every
day tlcitltzlly on duty at any parade required by
law, one dollar and lift y cents each; and in
addition, one dollar iiud fifty cents to all com-
niaiidiug officers of regiineiits, for each day, no-
_fuall_y employed in liearing and deciding appeals
for the roiiiissioii or niitigation of penalties, nbt
exceeding ten days in any one year.

Size. 41. No non-coniniissioiied officer, musi-
cian, or private of any uniform company in this
state shall he discliargcd froni any such company.
until after having served ten years from the
time of cnlisfnieiit into said coinpiiiiy, unless
disability should absolutely incapacitate him to
perform such duty, or should )‘F.glllt1l'ly be dis-
eluirgod by the proper officers or shall liuvo
tllilttillfiitl the age of thirty-five years, or shall
have removed out of the limits of tho regiinout
to which he belongs.

Size. 42. It shall be the duty of the collector"
of state taxes to receive such conniiutation money,
from time to time, as required by this act, mid
to give the person so commuting in receipt for
rhe same, stating the town in which the same
shall so be paid ; which receipt shall be sum-
ciont evidence to the person paying the same, of
his oxeinption as ‘aforesaid; and such collector
shall annually on or before the first day of No-
veuiber in each year, l'.l'tHlSn)ll'. to the command-
ing ofiiccr of the regiment located within the
county in which he resides, in list of all
such persons as shall have paid such commu-
taition.

Size. 43. Such collector shall on or before
the first day of October in every your, pay all
monies received by him, as u commutation for
niilitiiry duty. to the Ticasurer of the stiite--
retaining on all such moneys paid, seven per
cent. us his conipeusiition, and also the sum of
two cents, for each name enrolled as provided
in the second section of this act.

Size. 4-1. If any collector of state taxes shall
refuse or neglect to pay to the state Trerisurer
the moneys required by t.his act or either of
them, or to account for the ,same as unpaid, or.
to perform any duties required by this act, he
shall forfeit to the state the sum of not less
than twenty-five dollars nor more than one
hundred dollars; to be recovered by any court
of competent jurisdiction, in an action of debt in
the niiines of the state treasurer.

Size. 45. It: shall be the duty of the com‘-
mandant of every company to keep 8 book 0:‘
books in which licslnill on the day of any parade
required by law, register the names of delin-
quents for DOT]-:l[)p8tll'tl.l)C6. disobedience of or-
ders, unofficer like or uiisoldier like conduct, or
neglect. of duty, and the nines of all persons
who shall be deficient in uniform, arms, equip-
ments .2 iiccoutrements; .r. opposite to & under

such names he shall state first, (as the case may ‘

occur) absence at any roll call; (stating the day
and liouron which roll call was made secand,dis-
obedience of orders and wherein; third, refusal
and neglect; of duty and wherein; fourth, unof-
ficer like and unsoldier like conduct; and wherein;
_/if/I1, deficiency in arms and accoutrements and
wherein. Each of the above delinquencies and
deficiencies shall in such book or books be fully
written or expressed, with such explanations as
ho iiiay deem proper to make ; and to each of-
fence he shall affix the penalty now imposed by
law which each person so offending shall be
liable to pay, and said commanding officer shall
at the close of any parade notify, or within five
days tliereiifter cause to be notified by any com-
missioned or non-commissioned officer, all such
persons as shall have incurred any penalty im-
posed by law, and the amount. thereof; also the
day on which appeals will be heard by the coin-
manding officer of the regiment.

Size. 46. It shall be the duty of command-
ants of companies, within ten days after any
parade, to deliver such book or books to the com-
nianding officer ofhis regiment, certified to that
each delinquent therein named had been duly
notified thereof.

Size. 47. Every such non commissioned offi-
cer. musician and private who shall be returned
in such book or books to the commanding officer
of his regiment as being liable to any of the pen-
alties l:berein mentioned, may appeal to such
couunanding officer to remit or mitigate any such
penalty. _

Size. 48. Such commanding officer ofa. regi-
ment shall cause to be read in orders at each ml!
call, or on any day of parade required by law".
the time and place, within fifteen days after any
such puriule, where he will hear all appeals
which shall then and there be made to him for
the remission or initigrition of any such penalty.

Size. 49. Such eomrnaiiding officer of ii regi-
ment shnll have power to hear and determine
all such appeals ; to issue subpoenas for all wit-
nesses whose iittendance tit such appeal may in.
his opinion be necessary in behalf of the state,
and also on application for all witnesses in be-
half ofuny non-commissioned officer, priyate of
person returned for any delinquency or deficien-
cy. He shall also have power to administer the‘
usual oath of witnesses to be sworn audtestify.
