Sect. 12. Each school society shall have
power to form, alter, or dissolve school dis-
tricts within its limits, and any two or nibre
societies may form a district of adjoining
portions of their several societies, and may
alter and dissolve the same, and such dis-
trict shall belong to the society in which
the'school house shall be situated : Provided
That no new district shall be formed with
icss than 40 pt-rsons over 4 and under l6
years of age, nor shall any existing district,
by the forinzition of a new one be reduced
below the saute number of like persons:
Provided further, That no alteration shall
be made in the limits of any district incor-
porated by special act of the Gcueral.As-
sembly, unless such alterations be asked for,
or confirmed by a meeting of said district
warned for the purpose.
Sect l3. When arty two or more districts
shall be consolidated into one. the new dis-
trict shall own all the corporate property of
the several distrit-ts; when a (1lSl.llCl. shall
be divided, the funds and pI'0pcl‘ty or the in-
come and proct=.t=ds thereof, belonging to such
district. shall be distributed ainongthe sever-
al parts in proportion to the number of per-
sons between the ages of 4 and 16 in each,
and in case the distribution shall not be made
before the district is divided, and the several
parts cannot agree, the couitttittce of the
school society shall distribute the same.
Sect. 14. Every school district shall hold

ficr-rs, and for the transaction of any other
business relating to schools in said districts is.

of the time and place of evrry annual meet-

special meeting of the district shall be given
at least five days inclusive previous to hold-
ing" the same. The district committee, or, if
there be no such committee, the clerk, or if
there be no committee and no clerk, then the
_ cornmittee of the society shall give the notice
ofa district meeting, either by publishing
the same in a netvspnpcr printed in the dis-
trict, or by putting the notice on the district
schoolhouse, or on a sign post within thedis-
trict, or in some other mode previously (le.
signaled .-._by the district: but if there be no
such newspaper,-school house, nor sign post
nor other mode so designated, then the corti-
mittee of the school socivty to which such
district belongs. Shall determine how and
where the notices sliall be given. Every
person residing in the district qualified to
vote in town meeting, may vote in district
meetings.’ Every meeting may choose its
own moderator, and may adjourn from time
to time to meet at the Saint.‘ or sortie other

Sect. 15. The name or number, and the
limits of every school district shall be enter-
ed on the records ofsuch district, and on the
records ofthe scho_ol society to which such
district bi-longs. Whenever the boundary
lines of any district are not clearly settled and
defined. the school committee of the society
in which the district is situated shall settle 5;
dt-fine the same, and when parts of such dis-
trict lie in two or more societies,the com'niit-
tee ofthe school society in which any such
part is situated, shall settle and define the
boundary lines ofsuch part.
Sect. 16. Every school district shall bea
body corporate, and shall have power to sue
and be sued; to purchase, receive, hold and
convey any real or personal property for
school purposes; to build. purchase, hire &
repair school houses, and to supply the same
with fuel, fu ruiture. and other appendages and
accommodations ; to purchase maps, globes,
black boards, and other school apparatus;
to establish and maintain a school library; to
employ one or more. teachers ; to lay taxes,
and to iiiake all latvlulagreetnt-nts and reg-
ulations for establishing and conductitig
schools not inconsistent with the rcgulatioris
ofthe school society to which such district
belongs.
Sect. 17'. Each schooldistrict shall choose.
at the annual meetinc. a coivsmittee of not
more than t_hree residents of the district, a
clerk who shall be sworn, a treasurer, and
collector, who shall hold their respective of-
fices till the next annual meeting, and until
others are chosen or appointed, and any per-
son so chosen who shall refuse or neglect to
perform the duties of the office, shall pay $5
to the treasurer of the district, for the use of
said district, provided that any new district
may choose their officers at their first, or at
any subsequent meeting called by a commit-
tee of the society. who shall hold their office
till the next annual meeting of school dis-'
tricts. '
Sec; 18. In case any district at the 1.11111’

death, removal from the district or otherwise

school rooms, and furnish the same with fuel
properly prepared; shall visit the schools by

that the scholars are properly supplied with
school books, and in case they are not, and

notified thereof by theteacher, shall provide

add the price thereof to the next school tax
or rate of such parent, guardians, or mas-
ters; shall suspend during pleasure, or ex-
pel from school durirg the current session,
all pupils found guilty on full bearing of in-

information and assistance to the school coin-
mittees and visitors of the socit-ty, as they
may require, and perform all other lawful
acts as may be required of them by the dis-
trict, or which may be necessary to carry in-
to full effect the powers and duties of school
districts.
S: c. 20. The clerk, tre:isure’,'and collec-
tor of each school district shall exercise the
same powers, and perlom the same duties in
their respective districts, as the clerk, treas-
urer and collector of school societies do in
their respective societies. 1
Sect. 2]. The vote of two thirds of any le-
gal meeting shall be necessary to fix the site-
ofa new school house, or change the’ site of
an old one, but ifsttch vote oftwothirds can-
not be obtained in favor ofany site, the com-
mittee ofthe schools society, or the commit-
tees ofthe school societies. in which such
district is lot-att-d, on application of the dis-
trict shall fix the site, and uialre return there-
of to the clerk of the district and to the clerk
ofthe society in which such site shall be.
Union I)z'slvricIs.
Sect. 22. Any two or more adjoining
school districts may associate together and
form a union district, with powcrto maintain
a union school to he kept for the older and
iuore advanced children of such united dis-
tricis ifthe inhitbitanis of each of such dis-
tricts shall at legal meetings called for that
purpose vote to form such union.
Sect 23. Any itnion district thus formed
shall have all the powers of other school
districts, and shall hold its first meeting for
the choice of officers and the transaction of
any other business on such notice and at
such time and place as may be directed by
the cointiiittecs of the districts thus united.
Sect. 24. Theannual meeting of such un-
ion district shall be held at such time and
place, and upon such notice as the district
may prescribe, and notice of all meetings
Shall be given as provided for in the case of
school districts.
Sect. 25. Every union districtmay choose
a committee of one or three persons, a clerk,
at treasurer, and a collector, who shall have
all the powers and discharge all the duties
in reference to such district, as like officers
have in other districts.
Se-ct. 26" The union district committee
shall determine the age and qtialifications of
the children, who may attend the union
school, and make rules and regulations for
the studies, books, & discipline of the schools,

the school society to which said union dis-
trict belongs. and to any vote of the district.
Sect. 27. Every union school shall receive
such proportion of all nioucy accruing to the
use of, each of the united districts, as the
number of children attending the union
school frotn each of said districts, is to the
number attending the district school in each.

as the legal voters of the saute shall prescribe
and a tax or rate for this purpose may be as-
sessed and collected in the same manner as
in the case of any other school district.

Sect. 28. No teacher shall be employed
in any school supported by any portion of the
public money, until he or she has received
a certificate of examination and approbation
signed by a majority of the board visiters,
or by all the committee by them appointed,
nor shall any teacher’b‘e,cntitled to draw
any portion of his or her wages, so far . as
the same is paid out of any public money
appropriated by law to schools, unless he or
she can produce such certificate dated pre-
vious to the opening of his or her school-
provided that no new certificate shall be
necessary, when the teacher is continued in
the same school more than one term, unless
the visitors shall require it.
St.-ct. 29. It shall be the duty of every
teacher in any common school. to enter in a
book, or a register to be provided by the clerk
at the expens of the district, the names of
all the scholarsattending school, their ages.
the date when commenced, the length of
time they continue, and their daily attendance
together with the day ofthe month on which
such school was visited by the school visit-
ors of the society or committee by them ap-
pointed, which book. or register, shall be
open at all times to the inspection of all per-
sons interested, and be delivered over by the
teacher at the close of the term, to the dis-
trict clerk, together with a certified abstract
showing the number of males and fernalcs
and the average daily attendance-—and it
shall be unlawful to pay any teacher mote
than twothirds ofthe amount due for any
term of tuition. until said book and certified
abstract shall be placed in the hands of the
uistrict clerk. ,

month of August, ascertain the name of every
person over 4 and under 16 years of age,

The committee of the school society shall
examine and correct the returns made to
them, so that no person be enumerated twice
in diflcrent districts or be improperly return-
ed, and shall prepare and transmit to the
comptroller of public accounts, on or before
the fifteenth of September annually at certifi-
cate in which, the number of persons shall
"be inserted at full length, and which shall
be sworn to according to the following form,
to wit : I

The school society committee shall lodge.-

Sec. 31. The comptroller of public itc-
cottnts, on application of any school society,
shall draw an order on the treasurer for the
amount which such school society may be
entitled to, of all moneys appropriated by
law for the benefit, support and encourage-
ment of common schools, which may be in
the treasury on the lst days 91 March and
October annually; provided that no order
shall be drawn in favor of any society, until
the committee of such society shall certify
