nually be appointed by the Senate, three persons
Commissioners, which Commissioners or either
two of them shall annually in the month of July,
and oftener if need be, inspect the works erect-
ed and established by said company in Connecti-
cut river, and if in their opinion said works are
so much out of repair that boats cannot convexi-
iently pass through said locks, they are autliuri-'-
zed to suspend the right of said company to tail-:c'
toll until in the opinion of the Commissi'onei‘s,
said locks shall be repaired sufficiently for boats
to pass conveniently ; of which sllS_pt:l‘.Sl()D, the
Commissioner shall give notice by publishing the
same in a paper printed at Haitford. And no trill
shall be received at said locks, until the prop:i'e-
tors shall obtain from the C0lTtlllISSltT«ITCl'S a cer-
tificate that the same have been so.f~.~.r mplctcd
as to acommoclate the passage of boats up and
down the river.
§ 3. Be it furzlier enacted, That the Commis-
sioners are authorized to view the dams eiected
in and upon Connecticut river by said company,
and if in their opinion they are so constructed as
in any manner to impede the passage of fish up
the river, or the floating of timber or boats down
the same, at all times, in the lowest pan: of the
the dams, upon notice given to the clerk of said
company, it shall be the duty of the said compa-
ny to remove or alter the same, to the satisfaction
of the commissioners, in a reasonable time there-
after,,and upon failim: thereof, it shall be the du-
ty of the commissioners to cause said ob§.triic-
tions to be removed ; and the cxpence of giving
notice, and of removing said obstructions shall he
paid by the proprietors of said Locks and Chan-
nels. -
§4.~. Be. it fur-t/zier enacted, That each of said
Commissioners shall be allowed the sum of three
dolarsl for each day he shall be employed in ten-
dering the services required of him by this act.-
And the same shall be paid by the proprietors of
said locks and channels.
§5. Be izfurt/ier enacted, That the said pm-
prietors be, and they are hereby aiithorised and
empowered to purchase and hold such real estate,
not exceeding one hundred acres, at and near said
falls, as may be necessary for the location, cruc-
tion, accommodation and security of said woiks. .
§ 6. Jud be it further enacted, That if any per-
son or persons, shall wilfully destroy, or injuie
any of said wfiks, they shall, on being found guil-
ty thereof, before any court proper to try the

Provided,howerer,tliat this act, or any part there-
of, may be, at any time, altered, amended, or re-
vokedby the General Assembly.

hereafter be appointed by the Senate upon the
nomination of the governor, and in case either
of said ofiices shall be vacant dining the recess
of the General Assembly, the vacancy shall, be
filled by the Governor, and any pci’son thus ap-
pointed shall hold his OITICC until the session of
the General Assembly next after such appoint-
ment. '
