An act in alteration of an act, entitled ‘An act
‘for appointing and directing Commissioners of
' Sewers and Scavengers. _,
ԤlB E it enacted by the Senate and Home of

-vened, That the county Courts in the‘ respective _
counties be, and they are hereby authorized and
etnpowe_red_upon applicataion to them made, by
the major part of the proprietors of any such
lands as are described in said act, to grant corn-
missions of Sewers, to such and so many able
and discreet persons, as they shall judge expedi-
ent, for clearing and removing the banks and ob-‘
structions of the passages of the water, in rivers,
brooks, streams, or ponds, which occasion the
overflowing, and drowning of meadows, swamps,
and low lands : and also for flowing and draining;
s.wamps~and other unprofitable ground : and also
for damming to prevent the water overflowing 5
marshy and flat lands ; which commissions shall
be signed by the clerk of the Court granting-the‘ "
same, and the Commissioners shall thereby be -.
empowered to do the services aforesaid, and t-‘lg 1
and laborers, for such reasona- .

§2. Be it further enacted, That the commis-
sioners sball be sworn to a faithful discharge of
their trust, and shall receive such compensation
out of said assessments for their time, and ex-
penses as said Court shall allow, to which Court
said Commissioners shall be accountable when
thereto required. , . ‘
§3. Provided that if any person shall he aft;-=
grieved at any procedure of said Commissioners‘-.
or of any others in pursuance of this act, he or
she may appeal, or complain to said court, and
such relief shall be granted, as the justice and ha-
ture of the case may reqt.ii‘e. '
§4-. Be itjurtlier enacted, That when any pe-
tition shall be brought in pursuance of ‘-.hc pro-
visions of this act, notice thereof in tvriting shall
be given to all the proprietors of the lands descri-
bed in the petition. who have not subscriber: the
same, at least twelve days previous to tin sitting
of the court to which said petition shallbe hrotzghl‘.
by reading said petition in the lie-aring‘ of sucli
proprietor‘ or proprietors, or by leaving at true
and attested copy thereof, at his, or her last, and
usual place of abode, which notice shall be sign-
ed by a justice of the peace and directed to the
Sheriff of the County, his Deputy. or to either
of the Constables of the town where such land is
situated. .
§5. Be it further enacted, That the first, sec-
ond and fourth sections of said act of which this
is an alteration, be and they are hereby repeat-
ed.

so soon as a contfenient Court House, and Gaol
shall have been erected in the town ofllrooklyn,
in the county of Windham, at a place to be fixed ._
by three persons, or any two of them to be ap.
pointed by the County Court for said County, a

the Meeting House, to the acceptance of any two
of the Judges of the Superior Court, for the
time being,the County and Superior courts,with.
