An act relative to the election of Senators and
Representatives, for this state, in the Con-
gress of the United States. '
§ I. BE it enacted by tile Senate and House Q,’
Rcfjzrescntatfvcs in General Assembly cont-cited,
That whenever‘ any vacancy shall happen in‘. the
United States, by resignation or otherwise, ‘the
General Assembly if then in session, shall, by a
concurrent vote of the senate and house of rep-
resentatives, proceed to fill said vacancy, by a
new election ', and in case such vacancy shall hap-
pen in the recess of the General Assembly, the
Governor sh_alI,appoint some person to fill the
same, until the then next meeting of the Gener-
al Assembly.
§ 2. Be it fur:/mr enacted, That the electors of
the several towns in this state, at the gneetiiig of
the electors on the first Monday of April-in the
year of our Lord one tliousand ‘eight hundred and
twenty-one, and at the meetings of the electors
in April of every second year Vtli_er‘e"aftc:r, imme-
diately after giving in their votes for secret-...r;r,
shall be called upon by the presiding ofl"1cer,t:>
bring in their ballots for seven persons, to repre-
sent this state in the Congress of the United
States, aiid each elector p1-escnt, may thereupon-
deliver his vote or suffrage tothe presiding offi-
cer, for a‘ number of person's‘, not exceeding sev-
en, whom he would choose to represent this state
in the Congress of the United States, with the
names fairly written onone piece of paper ;’ the
presidingoliicer assisted by the town clerk and
select-melt, shall count the votes and declare them
in the public meetings of the electors; he shall
also make out and certify, duplicate lists of the
persons voted fbr, and of th'e number of votes
given for each person, one of which lists shall be
delivered to the town clerk of the town in which
such votes shall be given, within three days after
said meetings ; and the other shall be delivered
within ten days after said meetings, under seal,
either to the secretatzy or to the sherifi' of the
county in which said town _is situate, which lists
shall be directed to the seét'e'ta1‘y, with a super-
scription expressing the purport of the contents
thereof. And each sheriff who shall receive such
votes, shall within fifteen days after said meetings
deliver or cause them to be delivered to the se-
cretary.
§3. Be it fur:/.-'c'r crzdcird, That the treasurer,
secretary, and controller, for the time being, shall
canvass publicly within the month of April 1821,
and once in two years‘ thereafter, the votes retur-
ned to thesecretary as aforesaid ; the seven per-
sons having the greatest number of votes for rep-
resentatives in the Conggess of the United States,
shall be declared to be elected. The original re-
turns of votes and the result of the canvass, shall
be submitted to the General Assembly on the

vacancy shall happen in the representation ofthe
people of this state, in the Congress of the Uni-
ted States, the person arlmitzistcring the oflice of
Governor" shall make out writs of election under

fill such vacancy, and ca_r.se them to be convey-
ed to the sheriffs of the respective counties, who

to their several directions, and the constables a-
foresaid on receiving the same, shall warn a meet-
ing of the electors on the day directed in ‘said
writs, which day shall be the same throughout
this state. And the electors having assembled
pursuant to said warnings, a presiding oliicer of
each meeting shall be designated in the same
manner as is by law provided for the appointment
of presiding oflicers of the annual meetings of
the electors in April. And each elector present
at such meetings, may give in his vote for one or
more person or persons, as may be ‘required to
fill such vacancy, his or their name or names be-
ing fairly written one piece of paper, and the pre-
siding oflicer shall receive such votes, and with
